PC 72-88~ • RESOLUTION N0. p~7Z-88 A RESOLUTION OF THE CITY PLANNING COMMISSIDN OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. ~~SK BE GRANTED WHEREAS, the City Planning Commission oE the City~ of Anaheim did receive a veritied Petition for Vedence from CALPROP CORPORATION, Attention of 7ames S. Thet the petitioner rcauests a veriance from the Annhelm Municipel Code a s f o 11 ows : SECTION 18.28.050(5-b) - Maximum height of a building within 150 feet of an R-A Zone. (One story permitted; two stories proposed) 2. That the petitioner proposes to establish two-story units within 150 feet of R-A property to the south. 3. That there are exceptional os extreordinery circumstences or conditions applicable to the property involved or to the intended use of the property that do not epply generelly to the property or cless of use in the same vicirtity and zone. 4. That the requested variance is necessery (or the preservetion and enjoyment of e substentiel pcoperty rigl,t possessed by other prope~ty in the seme vicinity end zone, end denied to the property in question. 5• That the requested varience will not be matertelly detrimental to the public welfere or injurious to the pmp- erty or improvements in such vicinity end zone ln which the property is loceted. NOW, THEREFORE, BE IT RESOLVEP that t}~e Anaheim City Plenning Cammission does hereby grant subject Petition tor Varience, upon the following conditions which are hereby found to be a necessery prerequisite to the pro- posed use of the subject property in order to prestrve the sefety and generel welEere of the Citizens of the City of pneheim: 1. That this variance is granted subject to the completion of Reclassifi- cation No. 70-71-13 and Conditional Use Permit No. 1202, now pending. ?. That subject property shall be developed substantially in accordance with the conceptual plans on file; provided, however, that specific plans for the development of Phase iI shall be submitted to the Planning Commission and City Council for approval prior to the introduction of an ordinance rezoning the property under Reclassification No. 70-71-13.
