PC 72-90~ RESOL[JTION NO PC72-90 ~ A RESOLUTION OF THE CITY PLANNING COMhSISSION OF THE CITY OF ANAHEIM RECOMMENDING TO l'HE CITY COUNCIL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. ~l'72"43 BE APPROVED WHEREAS, the City Plenning Commission of the City of Aneheim did receive a vediied Petition for Reclessifica- tionfrom KATELLA REALTY, INCOFtPORATED, Attention of Melvin R. Sch~ntz, 1741 Katella Avenue, Anaheim, California 92804, and 2~IItS. GEORGE E. OYSTELTEN, 1745 South Varnm Street, Anaheim, California 92804, OwnQrs; BEAN S, OLSEN, 1741 Katella Avenue, Anaheim, California 92804, Agent of certain real property situated in the City of Anaheim, Gounty of Orange, State of California, deacribed as Lot 2 of Tract No. 2176 ; and WHEREAS, the City Plenning Commission did hold e public heering et the Clty Hell in thc City of Aneheim on May 1, 1972, at 2:OJ o'clock P.M. notice of seid public hearing heving been duly glven es required by laK and in accordence with the provisIons of the Anaheim Alunicipal Code, Chapter 18,72, to heer end conaider evideryce for end egainst said pioposed ceclsssificetion end to investigate end meke findings end recammendetions in connection therewith; and WHEREAS, seid Commission, efter due inspection, investigation, end study mede by itself and in its behelf, end efter due consideretion of ell evldence and reports offered et seid heering, does Eind end determine the fellowing fects: 1. That the petitioner pcoposes e reclassificetion of the ebove described property Erom the R-1, ONE FAMILY RESIDENTIAL, ZONE to the C-1, GENERAL CONAiERCIAL 20NE. 2, That the proposed reclassification ie in conformance with the General Plan. 3. Thet the pcoposed rbclessificefion of subJect propecty is necessery ena/or desireble for the orderly end pro- per development of the community. 4. Thet tlie proposed ceclessificetion of subject property does properly relete to the zones end their permltted uses locelly estebliahed in close proximity to subJect property and to the zones end thelr permitted uses generelly estob- lished throughout the community. 5. That the propoaed reclaseification of euUject property requires the dedication and improvement of abutting streets in accordance wilth t:he Circulation L•'1.r.:^ent of the General Plan, dpe to the anticipated incsease in traffic wh:Lch will be generated by the intensifi- cation of'land use. 6. R-A '1' NOW, THEREFORE, BE IT~SOLVED thet the Anahnim City Plennin~Commtssion does heceby cecommmd to the C:ty Councll of the Clty of Aneheim thnt eubjecf Petition for Reclaeeificatian be eppmved end, by so daing, thet Title 1&Zoning of the Aneheim Municipal Code be amended to exclude the above deacribed property from the R-1, UNE FAitILY RESIDENTIAL, ZONE 8nd to iricorporate said desc.ribed property into the C-1, GENGRAL COMMERCIAL, ZONE upon the following conditions which are hareby found to be a nec- essary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Aaaheim: (1) That the owners of subject property ehall pay to Che City of Anaheim the sum of $2.00 pet front foot along the northerly 60 feet of Varna Street for street lighting pur- poses. (2) That trash ctorage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. (3) That a 6-foot masonry wall shall be conatructed along the narth property line and to the rear of the required 3-foot planting strip separating the parking area from Varna Street. (4) That all air conditioning faciliLies shall Ue properly ah:telded from view, and the sound buffered from adjacent reaidences. (5) That any parking area lighting proposed ahall be down-lighting of a maximum height of 8 feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. (6) That subject property shall be aerved by underground utilities. (7) That the sidewelks shall be installed alang Varna Street as required by the City F.ngineer and in accordance with standard plans and specifications on file in the off•Lce of the City Engineer. (8) That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos, 1 and 2. (9) Prior to the introduction of an ordinance rezoning subject property, Condition No. 1, above mentioned, shall be completed. The provisione or righta grant•ed by this reaolution ahall become null and void by action of the City Counci.l unlesa said conditiona are complied witY~ within 180 days from the date hereof or auch further time as the City Council may grant. (10) That Condition Nos. 2, 3, 4, 5, 6 and 7, above mentioned, shall be complied with prior to final building and zoning inspectiona.
