That there are exceptionel or extraordinary circumstencas or conditions applicable to the property involved or to the intended use of the property that do not apply generelly to the propecty or cless of use in the same vicinity and ±one. 3. That the requested variance is necessary Eor the preservaGion and enjoyment of a subsCantiel p:operty rig~t possessed by other pruperty in the seme vicinity and zone, end denied to the property in question. 4. That the requested varience will not be meteriaily detrimente: to the public welfare or injurious to the pcup- erty or improvements in such vicinity and zone in which the pcopecty is located. 5. That the exiating drugstore/grocery on tlie same property was granted a similar waiver. 6. That the petitioner stipulated to construction of a two-foot high decorative mseonry wall with planta to be displayed as e landscaped buffar behind sai.d well a~d that display of all other merchandise would be behind the pYants and ~sould not be stacked to a height above the plants. 7, That one peraon appeared in oppoeition. V1-G -1- ~ ~ NOW, THEREFORE, BE 1T RESOLVEU thet the Aneheim City Plenning Commission does hereby grant subject Petition for Varience, upon the following conditions which ere hereby found to be e necessary prerequisite to the pro- posed use oE the subject pcopedy in order to pieserve the safety and generel welfare of the Citizens of the City of Anaheim: (1) That subject property shall be developed subatanCially in accordance with plans and s~ecificationa on file with the City of Analieim marked Exhibit Nos. 1 and 2 provided, however, that a two-foot high decorative masonry wall shall be constructed along the north- erly perimeter of the proposed display area as sCipulated by the petitioner. (2) That the plants shall be displayed behind the wall as a landacaged buffer and that the display of all other merchandise shall be behind the plants and not be atacked to a height ahove the plants as atipulated by the petition~er.
