WHEREAS, the City Planning Commission of the City of Anaheim did receive e verified Petition for Conditional UsePermitfrom ROBERT L. AND ETHEL L. WETZLER, 1533 Buena VisL•a, Apartment A, San Clemente, California 92672, Owners; PE'!'ER J. MUSCARELLA, 2954 West Ball Road, Anaheim, California 92804, Agent of certain real property situated in the City of Anaheim, County of. Orange, State of California, described as The North half of the Northwest '~ of the Northwest ~ of the Northwest '~ of Section 24, Township 4 South, Range 11 West, in the Rancho Los Coyoc~~s, as said section is ~liown on a map recorded ir. book 51, page ll, Miscellaneous Maps, records of said Orange Cou^!.y. EXCEPTING THEREFROM the Easterly 194.50 feet thereof. ALSO EXCEPT-. ING THEREFROM that portion conveyed to the State of California by deed recorded April 4, 1951 in Book 2180 at page 241 of Official Records of said Orange CounC: ; and WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City oE Anaheim on May 14, 1973, et 2:00 o'clock P.M., notice oE said pubiic hearing having been duly given as required by law and in accordence with the provisions of the Aneheim Municipal code, Chepter 18.64, to hear end consider evidence for and egair.st suid proposed conditional use and to investigate and make findings and recommendetions in connection thcrewith; end WHEREAS, said Commission, aEter due inspection, investigation, end study mede by itself end in its behelf, and aEter due consideretion of all evidence and reports offered et said heartng, does find end deteemine the following Eects: 1. Thet the propused use is properly one for which a Conditional Use Permit is nuthorized by Code Section 18.40.060(g) to wit: establish on-sale beer and wine in a proposed rentaurant. 2. Thet the proposed use will not adversel~ effect.the adjoining land uses end the growth and development of the erea in which it ie proposed to be loceted. 3. That the size and shape of the site proposed for the use is edequate to a(low the [ull development ofthe pcoposed use in a manner not detrimental to the perticular erea nor to the peace, health, safety, and general welfere of the Citizens ofthe City of Anaheim. 4. T'hat the granting of the Conditionel llse Permit under the conditions imposed, if nny, wlll not be detrimental to the peace, health, saEety, and generel welfare of the Citizens of the City of Anahetm. 5. That the petitioner stip~ilated Chere would be no bar and that the serving of beer and wine would be in conjunction with the serving of food. ENVIRONMENTAL IMPACT REP6RT PINDING: That the Planning Commis~ion, in connection with an F.xemption Declaration SCatua r2quest, finds and determines that the proposal would have no significant environmental impact and, therefore, recommends to the City Council that no Environmental Impact Stetement is necessary. Cl-G ~ 1~ . ~ ~ NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Plenning Commission does hereby gtent subject Petition for Conditional Use Permit, qaon the following conditions which ere hereby found to be a necessery prerequlsite to the proposed use nf the subject property in ocder to preserve the ssfety and generel welEere of the Citizens of the Clry of Aneheim: (1) That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. (2) That the serving of beer and wine shall be only incidental in conjunction with the serving of food and shall be served only at tables (no bar to be constructed) as stipu- lated by the petitioner.
