PC 73-109' .y_. ~ ~ RESOLUTION N0. pC73-109 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFYCATION N0. ~2-~3-51 gE APPROVED WHEREAS, the City Planning Commission o: the City of Aneheim did :initiate a verified Petition - for Reclassification of property situated in the City of Anaheim, County of Orange, State of California, known as the Mohler Drive Annexation, as described in Lxhibit "A" attached hereto and referred to herein as though set forth in full • ; and WHEREAS, the City Plenning Commission did hold e public hearing et the City Hell in the City oE Aneheim on May 14, 1973, at 7:30' : o'clock P.M. notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Meheim M,unicipal Code, Chapter 18.72, to hear and consider evidence for end against said pioposed reclessification end to investigate end make findings end recommendetions in connection therewith; end ~ WHEREAS, said Commission, efter due inspection, investigation, end study made by itself and in its behelf, end efter due consideretion of all evidence end reports ofEered et said hearing, does find and determine the following fects: P1 nning Commissi.on 1. That the~; : proposes a reclassificetion of the above described property from the R-A, AGRICULTURAL, ZONE to the R-H-22,000, RESIDENTIAL HILLSIDE, ZONE. 2. That the proposed reclassification is in conformance with the land use designation of the General Plan. ~. That the proposed ceclessification of subject property is necessary~ and/or desire~le for the orderly and pro- per development of the community. 4. Thet the proposed :eclessificetion of subject property does properly relete to the zones and their permitted uses locally established in close proximity to subject property and to the zones end their permitted uses generally esteb- lishedthrou hout the community. 5. 'iPhat the proposed reclassification of subiect property requises the dedication and improvement of abutting streets/alleys in accordance with the Circulation Element of the General Plan, due to the aciticipated increase in traffic which will be generate3 by the intensification of land use. 6. Pz ~e 3 72-73-51 • w 9' ~ NOW, THEREFORE, BE IT RE~ VED that the Anaheim City Plann~ing Commission does hereby recommend to the City Council of the City of Anaheim that subject Petition for Reclassifica- tion be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above described property frem the R-A, AGRICULTIIRAL, ZONE 8nd to in- corporate said descxibe~ prope.r.ty into the R-H-22,000, RESIDENTIAL HILLSIDE, ZONE, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: (1) That a preliminary title report sha7.1 be furnished prior to the adoption of the or- dinance rezoning the property, showing legal vesting of title, legal description, and contain- ing a map of the property, (2) That dedication shall be made to the City of Anaheim of all ~treets within the area, according to the_Circulation Element of the General Plan Highway Rights-of-Way, prior to the adoption of the ordinances rezoning the property. (3) That all engineer.ing requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by Che City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer, at the time the property is devel- oped. (4) That the owner(s) of subject property sha1Z install streeC lighting on all streets within the area as required by the Director. of Public Utilities at the time the property is developed. (5) That electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the requirements of the Director of Public Utilities. (6) That drainage of said p~operty shall be disposed of, in a manner sstisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to neces- sitate a grading permit, no work on grading will be permitted between November lst and April 15th unless all required off-site drainage facilities have been installed and are operat3.ve. Positive assurance shall be provided the City that auch drainage facilities will be completed prior to November lst. Necessary right-of-way for off-site drainage facilities shall be dedi- cated to the City, or the City Cnuncil shall have initiated condemnation proceedinga therefor (the casts of which shall be horne by the developer) prior to commencement of grading opera- tions. The required drainage facilities shall be of a size and type sufficient to carry run- off waters originating from higher properties through said property to ultimate disposal as approved by the City Engineer. Said 'drainage facilities shall be the first item of const-ruc- tion and shall be completed and be funcCional throughout the tract and from the downstream boundary of the property to the ultimate puin~ of disposal prior to the issuance of any final building inspections or occupancy pereiits. The Ctty shall not accept any portion of such drainage facilitiea until the entire fanility through the subject property and to the point of ultimate disposal is completed and operative. The developer shall maintain such facilities for a period of two years following installation and shall post a faithful performance bond in E sufficient amount to guarantee such maintenance. Drainage district reimbursement agree- ments may be made available to the developers of said property upon Cheir request. (7) That ordinances reclassifying the property shall be adopte3 as each pnrcel is ready to comply with conditions pertaining to such parcel provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split. (8) That prior to the adoptiun of an ordinance reclassifying the property or prior to approval of the final tract map, whichever occurs last, f2oor plans and elevations for the proposed houses shall be submitted to and approved by the Planning Commission and the City Council.
