NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commissiun does hereby grant subject Petition for Conditionel Use Permit, upon th~ following ccnditiona whic~ are hereby found to be a necessary prerequisite to the proposed usa of the subject property in order lo preserve the safety and general welfare of the Citizens of th~ City of Anaheim: (1) That this conditional use permit is granted subject tn the completion of Reclasai- fication No, 71-72-44 and Tentetive Map of Tract No. 7444, Revision No. Y, now pending. (2) That the vehicular access rights, except at street and/or alley openinga, to Nohl Ranch Road shall be dedicated to the City of Anaheim. (3) That the owner(s) of subject property ahall pay to the City of Anaheim the appro- priate park and recreation in-lieu fees as determined to be appropriate by the City Coiincil, said fees to be paid at the time the building permit ia issued. (4) That any proposed convenants, conditions, and restrictione shall be submitted to and approved by the City Attorney's Office prior to City Council approval of the final tract mep and, further, thst Che approved covenants, conditions, and res~rictions shall be recorded concurrently with [he final tract map. (5) That a final tract map of subject property shall be submiCted to and approved Uy the City Council and then be recorded in th~ ofiice of the Orange County Re^_order. (y) Thst prior to filing the final tract map, the applicar.t shall submit to the City Attorney for approval or denial a complete synopoie of the proposeJ functioning of the operating corporation including, but not limited to, the articles of incorporation by- laws, proposed methods of management, bonding to insure maintenance of common property and buildings, and such other information as the City Attorney may desir•e te protect the City, 'its citizens, and the purchasers of the projecL•. (7) ThaC grading, excavation, and all other conatruction activities shall b2 con- ducted in such a manner so ae to minimize the possibility of any silt originating from this project being carried into the Santa Ana River by storm water originating from or fiowing through thia pro~ect. (S) That drainage of said property shall be dispoaed of in a manner satisfactory to L•he City Engineer and shall include conatruction of drainage faci?itiea of a size and type sufficient to carry runoff waters originatittg from higher properties aouth of Santa Ana Canyon Road through said property to ultimate diaposal as approved by the City Engineer. Reimbursement agreements may be made available to the developers of said property upon their request. (9) That fire hydrante shall be inetalled and charged as required and deter.mined to be necessary by the Chief nf the Fire Department prior to commencement of structural fram- ing. (10) That subject property shall be deve?.oped su:.stantial~y in nccordance with plane and specifications on file with the City of. Anaheim mnrked Exhibit Nos. 1, 2, 3, 4, 5, 6, and 7. (11) That Condf'tion Nos. 1, 2, 4, 5, and 6, above mentioned, shail be complied with prior to the commer~cement of the activity authorized under this resolution, or prior to the time that the building permit is issued, 4r within a period of one year. from date hereof, whichever occurs first, or auch further. time as the Planning Commission may grant, (12) T~iat Condition Nos. 7, 8, 9~ and 10, above mentioned, sha~l be complied with prior to f!.nal h~::~ing and zoning inspectione, (13) T~~~ the tract map shall be revised to ref7.ect the potential for 31 additional parking spaces within open areas throughout the tract in the event of future needs; and that a bond in an amount and form saL•isfactory to the City o£ i+naheim ahsll be posted to guarantee the improvement of said parking spaces in the event o£ ~4 determinatian of park- ing shortages, as atipulated to by ~he petitioner. (15) That a special parkin.g study be conductedl to ascertain the nozmal parking demands as experiettced by the developer in these forms of development, said study to be subpitted to the Planning Commission for coneideration prior to the filing of a final tract map as stipu- lated to by the petitioner.
