PC73-11 A RESOLUTION OF THE CITY PLANNING COMMISSION Or' THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2504 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from GEORGE C. AND d-iJLIETTE PAGE, 730 Sarbonne Road, Los Angoles, California 90024, Owners; KENNETH W. HORNF, 2084 South Anaheim Boulevard, Anaheim, Californie 92805, Agent of certain real property situated in the City of Anaheim, County of Orange, State of Cali£ornia, as doscribed in Exhibit "A" attached hereto and referred to herein es though set fori~h in full WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the C~ty of Maheim on May, 30 , 1973 at 2:00 o'clock p.m., notice of said public hearing havir.g been duly given as required by law and in accordance with the provisions of the Maheim Municipal Code, Chapter 18.68, to hear and consider evide.ace for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study madc by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and defermine the following facts: 1. That the petitioner rcquests a variance from the Maheim Municipal Code as f ollows : a. SECTION 18.52.060(3-b) - Re4uired enclosure of outdoor uses. (6-foot masonry wall required; 6-foot slatted and un- s'!atted chainlink fenoe proposed) b. S~CTION 18.52.060(2-a) - Minimum front setback. (25 feet required; ` 0 feet proposed) 2. That the petitiuner proposes to cantinue the outdoox storage of tires in a tire wholesale and tire rebuilding faaility. 3. That the petitioner stipulated to providing radwood slats in the chain link fenoe around the entire perimeter of the property. 4. That the petitioner stipulated that the storage"of tires would not project e,bove the top of the slatted 6-foot high ohain link fence. ~ 5• That since the petitioner statad this would be an interim use, the Commission has detarmined that a two-year time limitation should be established for the use, subject to review by the Commission at the end of said time to'deternine whether the use sheuld be permitted to aontinue, and if allowed to continue then required fence setbacks and land- scaping shall be complied with along the frunt of ~he property in conformance with the M-1 site development standsrds. 6. That there are exceptional or extreordinary oircumstanoes or conditions applicable to the property involved or to the intended use of tha prouerty that do not apply generally to the property or class of use in the same vicinity and zone. NOW, 7''.~REFOfiE, BE IT RESOLUED that tho Anaheim City Planning Commission does hereby grant subject Petition Por Varianae, upon the following conditions which are hereby found to be a necessciry prerequisite to the propo~ad use of "tHe subject property in order to preserve the safety and general welPare of the Citizens of the City of Anaheim: (1) That the sidewalks and dr3veways shall be installed~along Anaheim Boulevard as required by the City Engineer and in sooordande with standard plans and speoifications on file in the offias of the City Engineer. - (2) That street lighting Yacilities along Aneheim'Boulovard shall be instaSled as required by the Direotor of Public Utilities and in accordance with standard plans and specifiorstions on file in the office of the Direotor of Publin Utilities and that a.bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantoe the iastallation of the above mer.tioned requirementa. ;3) That trash storage areas shall be provided in acoordanae with approved plans on file •uith the office of the Direator of Publia iNorks. (4) That fire hydrants shall be installed and'charged as required and determined to be necessary by the Chief of the Fire Department prior to commenoement of struotural framing. .. (5) That a paroel map i;o reoord the approved division of suSject property be submitted to and aporove3 by the City of Anaheim and then be reoorded in the office of the Orange County Recorder.
