PC73-118 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. ~512 _ AE GRAP:TED WHEREAS, the City Planning Commission of the City of Anaheim did reccive e verified Petition for Veriance from GIACOMO (JOHN) M. AND JOYCE E. LORE, 2440 Glenoaks Avenue, Anaheim, California 92801, Owners of certain real property situated in the City of Anaheim, County of Orange, State of Caliiornia, described as I.ot'99 of Tract 2390 as shown on a map secorded in book 71, pages 11 '' to 14 inclusive of Miscellaneous Maps, records of said Orange County ; end WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City oE Aneheim on May 30, 1973, at 2:00 o'ciock P.M., notice of said public hearing having been duly given es requiced by law and in eccordance with the pcovisions oE the Aneheim M'unicipel Code, Chapter 18.68,to hear and consider, ev:dence for and against seid proposed varia;~ce end to investigete and make findings and recommendetions in connec- tion therewith; end WHEREAS, said Commissinn, after due inspection, inveutigation, and study mede by itself and in its behalf, and aEter due consideretion of all evidence and reports offered at sr+id hearing, does find and detecmine the following facts: ' ~ 1. That the petit:oner reauests varianoes from the Anaheim Muniaipal Code as follows: a. SECTION 18.24.030(1-a) - Minlmum garage setbaok. (Between 6-10 foot setbaok or 25 foot minimum setbaak permitted~ot sei:baak proposed) "` b. SECTION 18.24.030(1-s) - Mi-~imum dwelling setbaok. ('L5 foot front setbaak required; 22 foot setbeok proposed? 2. That the patitioner proposes to relocate ttie garage door and driveway and oonstruat a 360 square foot addition to the existing home. 3. Thet there are exceptional or extraordinery circumstances or conditions appliceble to the propecty involved oc to the intended use of the property that do not epply generally to the property cr cless of use in the seme vicinity and zone. 4. Thet the requested variance is necessery Eor the preservation ann enjoyment of e substantial property right possessed by other property in the seme vicinity and zone, and denied to' th'e property in question. 5. That the requested variance will not be meterially detrimental to the public wel[are or injurious to the piop- erty ar impcovements in such vicinity and zone in which the property is loceted. ESv'VIRONMENTAL IMPACT REPORT PINDING: That the Planning Commission, in conneation with an Exemption Declaration Status request, finds and determines th~t the proposal would have no significant environmental impaat and, thorefore, reaonunends to the Cit;; Cowicil that no Environmental Impact Statement is neaes~ary.
