CITY PLANNING COAIMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2513 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Varience from ROY AND ZOLA DUNTON, 419 East Broadway, Anaheim, California 92806, Owners; RUSSELL AND SHIRLEY $P.USMAN, 3178 Flower .°treet, Lynwood, California 90262, Agents o£ ce•rtain real property situated in the City of Anaheim, County of Orange, State of (;alifornia, deacribed as Lot 24 and the Easterly rectangular 30 feet of Lot 25 in Block A of the Lorelei Tract, as per map recorded in book 29, page 24, Miscellaaeous Records of Los Angeles County, California ; and WHEREAS, the City Planning Commission did hold a public hearing et the City Hall in the City of Anaheim on May 30, 1973, at 2:00 o'clock P.M., notice of said public heacing having been duly given as requiced by lew and in eccordance with the provisions of the Anaheim Municipal Code, Chapter 18.68,to heer and consider evidence for and egainst said proposed veriance end to investigate nnd meke findings end recommendetions in connec- tion therewilh; and WHEREAS, said Commissinn, aEter due inspection, investigation, end stLdy made by itself end in i!s behelf, and aEter due consideration of all evidence end repocts offesed at said hearing, does find end determine the following Eects: ~ 1. That the petitianer ceauests a vecience fcom the Anet~eim Municipel Code as follows: a. SECTION 18.28.020 - Permittod uses (to establish a gift and antique shop in a residentisl struature? b. SECTION 18.40.070(4)(a)(2f) - Minimum number of required parking spaoes (4 parking spaces required; 2 parkin~ spaoes proposed) 2. That thece are ext~ptional or extraordinery ciccumstances or conditions app:iceble !o the property involved or to the intended use of the pro,:~rry tl;at do not epply generally to the property or cless of use in the seme viciriity and zone. 3. Thet the cequested veriance is necessery for the preservation and enjoyment of e substantial pca.perty right possessed by other property in the seme vicinity end zone, and denied to t'he peoperty in question. 4. That the requested variance will not be metecially detrimental to the public welfare or injurious to the pmp- erty or improvements in such vicinity end zone in which the property is loceted. ENJIRONMENTAL 1MPACT REPORT FIPJDING: , That the Planning Commission, in canneotion with an Exemption Declaretion St9tus request, finds and de't~rmines that the proposal would have no significant environmental impaot a:id therefore, recommends to the City Caurcil that no Environmental Impaat Statement is necessary• PC73-119 ~ . . .~ V1-G '1' NOW, THEREFORE, BE IT RE~JED thet the Anaheim City Plenning Co~sion does herehy grant subject ^ Petition for Variance, upon the following condltions which are heceby found to be a necescary pcecequisite to the pro- posed use of the subject pcoperty in order to pceserve the cafety end genecel welfere of the Citizens of the City of Anaheim: (1) That the owner(s) of subjeot property shall deed to the City of Anaheim a strip of land 10 feet in width from the aenterline of the alley for alley widening purposes. (2) That trash storage areas shall be provided in adaordance with approved plans on file with the office oS the llireator of Publia Works. ' (3) That the oxisting structure shall be brought up to the minimum standards oP the City of Anaheim, including the Uniform Building, Plumbing, Electriaal, Housing, ~enhanical and Fire Codes as adopted by the City of Anaheim. (4) That subject property shall be developed substantially in aacordanae with plans and speaifioations on file with the City of Anaheim marke'd Exhibit Nos. 1 and 2. (5) Thet C~ndition Nos. 1, 2 and 3, above mentioned, shall be oomplied with prior to the commenaement of the aotivity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof,whiah- ever occurs first, or such further time as the Planning Commission may grant.
