PC 73-123~ RESOLUTION NO.. A RESOLUTION OF THE CITY PLANNING COMMISSION OF1395 CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. BE GRANTED WHEREAS, the City Planning Commissicn of the City of Anaheim did receive a verified Petition for C~nditional Use Permitfrom DORA ODOM GONZALEZ, 1070~ Ril•ter Streee, Cyprese, California 90630, Owner of certain real praperty situated in the City of Anahe3m, County of Orange, State of Cali- fornia, described as Lots 3 and 4 of Block A of the Laird Subdivision, as per Map khereof recorded in Book 6, Page 12 of Miscellaneous Maps, records of Orange County ; end WHEREAS, the City. Planning Commissian did hoid a public hearing et the City Hall in the City of Aneheim on May 30~ 1973~ at 2;00 o'clock P.M., notice of said public hearing heving been duly given as cequired by law and in accordence with the provisions of the Anaheim Municipal code, Chepter 18.64, to hear end consider evidence for and agair.st said pcoposed conditionel use end to investigate and make Eir.d:ngs and recommendetions in connection therewith;'and NHEREAS, said Commissian, after due inspection, investigation, and study mede by itself and in its behalf, and after due consideration of all evidence end reports offece d at said hearing, does find end detettnine the following fects: 1. That the proposed use is pcopecly anE for which a Conditional Use Permit is authorized by Code Section 18.64.02U(1-a) to wit: establish a rest home for from six to ten women. 2, That since the proposed use is already in existence and several residents of the area expressed opposition to the manner in which the facility is being operated, particu- larly related to the lack of supervision of the "guests", the Planning Commis~ion determined that a time limitation of two years should be placed on the use in order to determine i:f the use would be detrimental to the area, and that a review by the Planning Com~uission should be made prior to any further considerations of extending the time limit. ,, That the proposed use will not adversely afEect. the adjoining land uses and the growth and development of the ares in which iE is proposed to be located. 4, Thut the size and shape of the site prop~sed [or the use is adequate to allow the full development of the pmposed use in a manner not detrimental to the pacticular area nor to the peace, health, sefety, and general welfuce oE the Citizens of the City of Ar.aheim. 5~,. That the granting of the Conditional Use Pennit under the conditions imposed, if any, will not be detrimental to the peace, health, saf=~y, and general welEare of the Citizens of the City of Aneheim. 6. That• until such time as the two residences are in compliance wiCh rhe Fire Code as to being sprinklered, only six guests, in addition to the housekeeper, shoul3 be permitted to rQSide on the premises. 7. That three persons appeared, representinb four per3ons present in the Council Chambe; expressiag concern that improper supervision of this fecility would he detrimental to the residential area. ~ ENVIRONMENTAL IMPACT REPOc~T.FINDING: ThaC the Plsriaing Commission, in connection with an Exempt•ion Declarati.on Seatus request, finds and det~rmines that the proposal would have r.o significant environmental impact and, therefure, rem mmends to the City Council thaC no Enviromnental Impact Statement is necessary. PC73-123 ~' Cl-G ~ 1 ' NOW, THEREFORE, BE 1T RES~VED thet the Aneheim City Planning Co~ssion does hereby g~ant subject petition for Conditionel Use Permit, upon the following conditions which ere heceby found to be e necesoary pxerequisite to the pcoposad use oE the sub}ect pcoperty in ocder to pcesetve the sefety end generel zelfece oE the Citizens of the City of Aneh~im: - 3 (1) That trash storage areas shall be provided in accordance with approved pl.ana on. file with.~the office of the Director of Public Works', (2)'~ That all air conditioning facilities shall be propetly shiFlded from view, end the sound buf£ered €rom adjacent properties. (3) That the existing structure shall be brought up to the minimum standards of the City of Anaheim, includirg the Uniform Building, Plumhing, Electrical, Housing, Meahanical and Fire Codes as adopted by the City oE Anaheim. (4) That subject property shall be developed substantially ia conformance with plans and specifications on file with the City of Anaheim,. marke3 Exhibit Nos. 1, 2, and 3. . (5) That Condition Nos. 1, 2, 3, and 4, above mentioned, s1~a17. be complied with prior to the commer.cement of the activity authorized under this resolution, or prior to tY.P time Y.hat the building permit is issued, or within a period of.one year from date hereof, whichever occurs fir3t, or such further time as the Planning Commission may graat. (6~ Tnat there shall be only six women plus a housekeeper residing on the premises until and unless the structures are made to comply with ttie`~}+rinkler requirements of the Fire Code, and that if scch sprinklers are installed, the petitiOrieY shall submit a written request to the Planning Commission asking for a review of the Conditional Use Permit to determine whether more than six ~6) "guests" should be allowed. (7) That a time limitation of two years shall be granted for the use to determine whether any detrimental ef.fects to the neighbarhood will result from the use; end that the use shall be reviewed upon written request, at the end of two'(2) years, or at such time as the owner brings the structures into compliance with the sprinkler requirements of the Fire Code.
