PC73-127 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2510 BE GRANTED IN PART WHEREAS, the City Planning Commis,ion of the City of Anaheim did receive n verified Petition for Varience from ROYAL CUACH OF ANAHEIM, INCORPORATED, 490 La Fayotte Road, Hampton, New Hampshire 03842, Owner; AD ART, INCORPORATED, 1715 64th Street, Emoryville, CaliYornis 94608, Agent of certain real property situated in the City of Anaheim, County of Crange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; end ~VHEREAS, tha City Plenning Commission did hold a public heering at the Cily Hall in the City of Aneheim on June 11, 1973 at 2:90 o'clack P.M., notice of •aeid public heacing heving been duly given es required by !aw and in eccordance wi;h the pravisions of the Aneheim Municipal Code, Chepter 18.68,to heer and consider evidence for end against said proposed veriance ond to investigete snd make findings end recommendetions in connec- tion therewith; and ~4'HEREAS, said Commissinn, efter due inspection, investigation, end study made by itselE and in its behelf, and after due consideration of all evidence and reports ofEered et said hearing, does find and determine the following facts: ~ :. That the petitioner :enuests a variance frotn the Aneheim Municipal Code es follows: SECTION 18.62.090(B-2) - Maximum height of a free-standing sign within 3U0 feet of a residenti.al structure (Z5 Yeet permitted; 58 feet praposed). 2. That Waiver uf the height limitation is granted in part permitting a sign a maximum of 43 feet in height, on tlie basis that a similar request for hoight waiver of 18 feet was granted for the motel to the south, thus granting the same right to the peti- tioner. 3. That there are exceptionol or extraardinary circumstances or conditions apQliceble to the propecty involved or to the intended use of the property that do not epply generally to the property or class of use in the same vicinity and zone. 4. That the requested verience is necessery for the preservaiion end enjoyment of a substential property right possessed by other propecty in the seme vicinity and zone, and denied to the property in question. 5, That the requested variance wil! not be metecially detrimental to the public welfatv or injurious to the pmp- erty or improvements in such vicinity and zone in which the property is loceted. ENVIRONMENTAL IMPACT fiEPORT FINDING: That the Planning Commission, in connection with an Exemption Declaration Status request, finds and determines that the ~,roposal would have no significant environmental impact, and tharefore, recommends to the City Counci'1 that no Environmental Impaot Statement is necessery.
