PC73-157 A RESOLUTION OF THE CITY PLANNING COMh1ISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2523 BE GRANTED WHEREAS, the Caty Plenning Commission of the City of Anehein did receive a vecified Petition for Veriencc from AUTOMATION INDUSTRI~S, Corporate Office, 1QC1 Building, Century City, Los Angeles, Cali- fornia 90a67, Owner; C F I MEMORIES, INCORPORfTED, 305 Crescent Way, Anaheim, California 92801, Agent•of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Beginning at the intersection of the centerline of Lincoln Avenue, 60.00 feet wide, witfi the southerly prolongation of that certain courae in the westerZy line of Crescent Way, as described in Parcel 2 in the deed to the City of Anatieim, recorded November 1, 1957 in Book 4089 Page 397, Official Records, as having a bearing and distance of North 0° 08' 37" West, :942.14 feet~ thence North 0° 08' 37" West, 1237.14 feet along said prolungation and said westerly line to the true point of beginning; thence North 89° 37~ 25" West, 354.05 feet to a line which is parallel with and distant 450.00 feet easterly of (measured at right angles to) L•he East line of Muller Avenue, as described in Parcel Or.e in the above mentioned deed to the ~ity of Anaheim; thence along said line, North 0° 02~ 24" West 250.00 feet; thence South 89° 37' ?5" West 353.59 feet to said West line of Crescent Way; thence along said West line, South 0° 08' 37" East, 250.01 feet to th~e true point of beginning ; and WHEREAS, tha City Planning Commission did hold a public hearing at the City Hall in the City oE Aneheim on July 23, 1973, at 2:00 o'clock P.M., notice of said public heacing heving been duly given as cequired by law and in eccocdance with the provisions of the Aneheim Municipel Code, Chepter 18.68,to hear end consider evid°nce for and ugainst seid propused varience end to investigete end make Eindings end cecommendations in connec- tion therewith; end WHEREAS, seid Commissinn, efter due inspection, investigation, end study made by itself end in its behelE, and after due consideration of all evidence end reports oEfeced et seid hearing, does find end determine the following fects: ' ~ 1. That the petitioner requests a veriance f:om the Aneheim Municipel Code: SECTION 18.52.060(3-b) - Required masonry well enclosint~ outdoor uses. (Six-foot high solid masonry wall required; si^,x-fuot high slatted chainlink fence proposed) 2. That there ace exceptionnl or extceordinery circumstances or conditions oppliceble to the property involved or to the intended use oE the property that do not apply generelly to the propert!~ or cless of use in the seme vicinity and zone. 3. Thet the reyuested varience is necessery for the preservation artd enjoyment of a substential pcopetty right possessed by other pcopecty in the seme vicinity and zone, and denied to the pcopedy in questian. 4. Thet ttie requested veriance will aot be meterially detrimentel to the public welfatc or injurious to the pmp- ecty or imp~ovements in such vicinity and zone in which the property is loceted. 5. That the petitioner stipulated to providing redwood slats ia the chainlink fence, ENVIRONMENTAL IMPACT REPORT FINDING: That Che Planning Commission, in connection with an Exemption Declaration Status request, finda and determines thaC the proposal would have nr.. significant environmental impact 2nd, therefore, reaommends to the GiCy Council that no Envirnnmental Impact Statement is neceseary. V1-G '1' • + NOW, THEREFORE, BE IT R~OLVED that the Aneheim City Plennirtg Co~mmission does hereby grant subject Petition for Vaciance, upon the following conditions which ere hereby fonnd to be e necessary pcerequisite to the pro- posed use of tl~e subject propecty in order to preserve the safety and generel welEace of the Citizens of the City of Anaheim: , , (1) That the owner(s) of aubject property shall deed to the City of Anaheim a strip of land 32 feet in aidth Erom the cenCerline of the street along Crescent Way for street widening purposes. (2) That the sidewalks shall be installed along Crescent 41ay. (3) That trash storage areas ehall be provided in eccordance with appraved plans on file with the office of the Director of Public Works. (4) That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1 provided, however, that redwood sLats shall be installed in the chainlink fence as stipulated to by the peti- tioner. (5) That the final parking plan shall be approved by the Development Services'Depart- u~ent, and any landscaped areas in the parking, area shall be prctected with $j.x-inch high concrete curbs, and concrete wheel stops shali be provided for parking spacea. (6) That Condition Nos. 1, 2, 3, 4, and 5, above mentioned, shall be complied with prior to the commencement o£ the activity authorized under this resolution, or prior to the time that the building pe~mit is issued, or within a period of one year from the date hereof, whichever occuXS first, qr such further time as the Planning Commisaion may grant.
