PC73-158 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2525 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a veriEied Petition for Veriance fcom LEE C. SHAMMIS, 94 Linda Isle, Newp~rt Beoch, California 92660; Owner; JOHN D, 0'DONNELL or TERRY BRIGHAM, 500 Newport Center Drive, Suite 640, Newport Beach, California 92660, Agent of certain real property situated in the City of Anaheim, County of Orange, State of Califorr.ia, as described in Exhibit "A" attached hereCO and referred to herein as though set forth in full ; end WHEREAS, the City Plenning Commission did hold a public heering at the City Hall in the City of Anaheim ort July 23, 1973, at 2:00 o'clock P.M., notice of said public heecing having been duly given es cequiced by lew end in eccordance with the provis:ons of the Aneheim MunicIpel Code, Chepter 18.68,to hear and consider evidence for and ugainst seid proposed varience end to investigete and make findings and recommendetions in connec- tion therewith; end WHEREAS, seid Commission, efter due inspection, investigatlon, end study mede by itselE and in its behalf, and aEter due consideration of all evidence end reports offered el said hearing, does find and determine the following facts: ~ 1. That the petitionec requests a variance from the Aneheim Municipal Code: SECTION 18.52.060(4)(A)_ - Minimum required number of parki.ng spaces. (84 spaces required; 45 spaces proposed) 2. That the petitioner propoaes to establish a mini-warehouse on subject property. 3, That there ece exceptionel or extraordi~ary circumstances or conditions eppliceble to the pcopecty :-volved or to the intended use of the property that do not apply generally to the property or class of ase in the seme vicinity and zone. 4, That the requested varia~ce is necessery for the pceservatian end.enjoyment of a substential property r'sght possessed by other property in the seme vicinity and zone, end denied to the propecty in question. 5. That the requested variance will not be matecially detrimental to the public welfate or injurious to the pmp- erty or improvements in such vicinity and zone in which the pcopedy is loceted. 6. That the petitioner stipulated to providing the traf£ic medisn along Brookhurst Street. 7, That the petiCioner stipulated to submitting a decorative wall treatment plan to t':e the Development Services Department and construction of same for the peripheral wt~lls of tne structures prop~sed for subject property. (2) That trasn storage aieas shall be provide3 in eccordence wfth approved plans on file with the office of the Director of Public Works, (3) That fire hydrants shall be installed and .earged as required and determined to be necessary by the Chief of Che Fire Department prior to commencement of structural framing. (4) That subject proparty shall be served by underground utilities. (5} That the finalxpsrking plan shall be approved by the DevP~l opment Services Department, and any landscaped areas in the parking area shall be protected with ~ix-inch high concrete curbs, and concrete wheel stops sha11 be provided for parkinb spaces. (6) That drainage of subject property shall be disposed of in a manner that is satis- factory to the City Engineer, (7) That a traffic median suitable to the City Traffic Engineer ve inatalled on Broolc- hurse Street, as stipulated ta by the petitioner, (8) That subject property shall be developed substantially in accordance wich plans and specifica!'ions on file with the City of Anaheim marked Exhibit Nos. 1, 2, and 3. (9) That Condition Nos, 1, 2, 4, 5, 6, 7 and 8, above mentioned, shall be complied with prior to final building and zoning inspections. (10) That a decorative wall treatment plan for the peripheral walls uf the structures on sub~ect property shall be suUmitted to the Development Services Department for review and approval, as stipulated to by the petitioner, prior to the issuance of a Building Permit for construction of said walls. Any decision made by the Development Services Department on said plan may be appealed to the Planning Commission and/or City Council.
