PC 73-169I . ,r RESOLU~ No. P~73-16g ~ A RESOLUTION OF THE CITY PLANNING COMMiSSION OF THE CITY OF ANAHEIM RECOAiMENDING TO THE CITY ~OUIdCIL OF THE CIiY OF ANAHEIM THAT PETITION FOR RECLASSIFIC;ATION NO. ~~'74'~ BE APPROVED ~, WHEREAS, the City Planning Commission of tha City of Anaheim did cecelve a verified Petition fot Reclassifice- tionfrom CHARLES AND PHYLLIS EiCHLER, 6888 Leilani Lane, Cypress, Ca-}ifornia 90630, Owners; BILL PHELPS, 1095 North Main Street, Orange, California 92667, Agent of certain real prop- erty situated in the City of Anaheim, County of Orange, State of Cal~fornia, described as PARCEL 1: The West 11U.OQ feet of the East 260.00 feet of :he West 390.00 feet of the North half of the Northeast quarter of the Northeas*_ quarter of the Southwest quarter of Section 14 in Township 4 South, Range 11 West, in the Rancho'Los Coyotes,;in the.G~ty of Anaheim, as shown on a map thereof recorded in book 51, page 7, Miscellaneous Maps, records of said Orange Courty, PARCEL 2: A well and pumping plant located on the Easterly 110 feet of the West 240 feet of the North half of the Northeast quarter o` the Northeast quarter of the Southwest quarter of Section 14, Township 4 South, Range 11 West, S.B.B. ~ M. EXCEPT that porti~n thereof described in the deed to the Orange County Flood Control District, record- ed February 5, i959, in book 4576, page 151, Official Records. ; and WHEREe1S, the City Planning Commission did hold a public hearing et the City Hell in the~cttty~sf enuhred bn August 6, 1973, at 2:00 o'clock P.M. notice of seid public hearing having been duly g 4 Y law end in accordence with the pcovisions of the Maheim Municipal Code, Chepter 18.72, to hear and consider evidence for and against said pioposed reclassification end to investigate end make findings und recommendetions in connection therewith; and WHEREAS, seid Commission, after due inspaction, investigation, and study made by itself and in its behelf, end after due consideration of all evidence and reports offered at seid hearing, does find and detErmine the following f+~cts: 1. Thet che petitioner propos~s a reclassification of the above desccibed property from the R-A, AGRICULTURAL ZONE to the R-3, MULTIPLE FAMILY RESIDENTIAL, ZONE. 2. That the proposed reclassification is in conformance with the land use designation of the General Plan. 3. Thet the proposed reclassificetion of subject pcoperty is necessery end/or desireble for the orderly end pro- per development of the community. 4. That the pcoposed ceclessificetion of subject propedy does properly relete to the zones and their pecmitted uses locally esteblished in close proximity to subject pcopecty and to the zones end theix permitted uses generally esteb- lished throughout the community. ENVIRONMENTAL IMPACT REI'ORT FINDING That the Planning Commi::sion in connection with an Exemption Declaratior Status request, finds and determines that the proposal woutd have no significant environmental impact, and therefore, recommends to t~~ie City Council that no Environmental Impact Statement is necessary. R-A ~1~ '' NOW, THEREFORE, BE I~SOLVED thet the Aneheim City Plann~ommission does he:eby cecommend to the City Council of the City o Aneheim that aub)ecf Petltion foc Recless Cication be epproved end, by so doing, that Title 18-Zoning of the Anaheim Municipel Code be amended to exclude the above described propcety fr~m the R-A, AGRICULTURAL, ZONE and to incorporate said descrit,ed property into the R-3, MULTIP~E- FAMILY RESIDENTIAL, ZONE, upon the following conditions which are hereby found to be a nscessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City,of Anaheim: (1) That the ov;ner(s) of subject property shall pay to the City of Anaheim the sum of 60G per f~ont foot along Orange Avenue for tree planting purposes. (2) That street lighting facilities along Orange Avenue shall be installed as required '~y the Director of Public Utilities, and in accordance with standard plans and specifications on file in the~office of the Direct~or of Public Utilities; and that a bond in an amo~nt and form satisfactory, to the City of A~naheim shall be posted with the City to guarantee the installatio~ of the above ;nentionecl requirements. (3) That trash storage areas shall be provided in accordance with approved plans on file with the office of the Direc•tt~r of Public Works. (4) That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of thc: Fire Department prior to coinmencement of structural framinq. . (5) That a 6-foot masonry wall shall be constructed along the east and west property 1 ir,es. (6) That a fence sFiall be constructed along the Carbon Creek Channel as required by the Orange Co,m~t+/~Flood Control District. (7) That subject property shali be served by underground utilities. (8) That the owr,er(s) of subject ~roperty shall pay to the City of Anaheim the appro- priate park and recreation in-lieu fees as determined te be appropriate by the City Council, said fees to be paid at the time the building permit is issued, (g) ihat drainage of subject property shall be disposed of in a manner that is satis- factoYy to the City Engineer. (10) That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid tc the City of Anaheim prior to the issuance of a building permit. {yt) Prior to the introduction of an ordirtance rezontng subject property, Condition Nos..t and 2, above mentioned, shall be completed, the provisions or rights granted by this resolution shall become null and void by action of the City,Council unless said con- ditions are complied with v~ithin ane year from the date hereof or such further time.as the City Council may grant. (12) That Condition Nos. 3, ~~, 6, 7, 9, a^d 11, above mentioned, shall be complied with prior to final building and ..oning inspections.
