PC 73-175~ ~ RESOLIJTION NO PC73-175 A RESOLUTION OF THE CITY PLANNING COMMISSION OF' THE CITY OF ANAHEiM11 THAT PETITION FOR VARIANCE N0. 2535 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a veclfied Petition Eor Varianee from COMET, INCORPORATED, Post Office Box 6366, Burbank, California 91510, Owner; GEORGE COLLINS, 1265 E3st Lincoln Ave~ue, Anaheim, California 92805. Agent of certain real property situated in the City of Anaheim, County of Orange, State of California described as PARCEL 1: That portion of Lot 4 of Anaheim Extension, as shown on a map by Wm, Hamel on file in the Recorder's office of Los Angeles County, California, bounded ar.d described as follows: BEGIN- NING at a point in the center line of Center Street as shown on said map of Anaheim Extension, distant thereof 520.13 feet Easterly from the center line of East Street, as shown on said map, and running thence Northerly parallel with said center line of East Street, 450 feet; thence Westerly, parallel with said center line of Center Street, 160 feet; thence Southerly, parallel with said center line of East Street~ 450 feet to said center line of Center Street; thence Easterly along sald center line 160 feet to the point of beginning. ; end WHEREAS, the City Plenning Commission did hold a public heering at the City Hell in the City of Aneheim on August 6, 1973, at 2:00 o'clock P.M., notice of said public heering heving bem duly given as cequired by lew and in accocdance with the provisions of the Anaheim Municipel Code, Chepter 18.68,to hear end considet evidence for end egeinst seid proposed verinnce and to investigete end make findings end recommendetions in connec- tlon therewith; a~d WHEREAS, seid Commission, aEter due inspection, investlgation, end study made by itselE and in its behelf, end efter due conslderetion of all evldence and reports offeced at said hearing, does Eind and determine the following fects: ~ 1. Thet the petitioner rectuests a variance trom the Anaheim Municipal Code as fol low5: SECTION 18.40.020 - Permitted uses: to permit a use (motorcycle service/repair) not permitted in the C-1 Zone. 2. That the use shculd be permitted for one year only, since the agent for Yhe petitioner stated that the owner of the building proposed to relocate and modernize the structure within that time, and if C-2 Zoning was not obtained he would move elsewhere. 3. ENV I RONMENTAL I MPACT P,EF'ORT F I ND I~dG: That the Planning Commi~tsion, in connection with an Exempt~ion Declaration Status requests, finds and determines thi3t the propnsal wo~~d have no signi'I~icant environmental impact and, therefore, recommends te~ the Cit~~ Cou~cil that no Environmi:ntal Impact Statement is neces5ary. V1-G '1- NOW, THEREFORE, BE IT RE~SOLVEC that the Aneheim City Plenning Commission does hereby grant subject Petition for Veriance, upon the folloaing conditions which ere hereby found to be a necessary prerequisite to the pro- posed use of the subject propedy in order to pceserve the safety end generel welfare ofthe Citizen~ of the Clty of Anaheim: , (1) That the owner(s) of subject property shall deed to the City of Anaheim a strip of land 53 feet in width from the centerline of the street along Lincoln Avenue for street widening purposes. (2) That street lighting facilities along Lincoln Avenue shall be installed as re- quired by the Director of Public Utilities and in accordance with standard plans and spec- ifications on file in the office of the Direttor of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim skall be posted with the City to guaran- tee the installation of the above mentioned requirement. ' (3) That the owner(s) of subject property shall pay to the City of A~aheim the sum of 60C per front foot along Lincoln Avenue for tree plan:ing purposes. (4) That subJect property shall be developed substantially in accordance with plans and specificatio~s on file with the City of Anaheim marked Exhicit Nos. 1 and 2. (5j That Condition Nos. 1, 2~ and 3, above mentioned, shall be complied with prior to the commencement ofi the activity authorized under this resolution, or prior to the tirne that the buildi~g permit is issued, or within a period of one year from date hereof, which- ever occurs first, or such further time as the Plannin9 Commission may grant. (6) That in order to determine whether any adverse effec! will result from the granting of the use, the Planning Commission grants a one year time limitation, since the petitioner stipulated that the property would be redev~loped and if proper zoning was not obtained at that time he would relocate the motorcycle sales and repair to a location which had proper zoning.
