That the proposed use is properly one for which a Conditional Use Permit is authorized by Code Sect i on 18.5z.060(3-B) to wit: expand an euisting Grive-in theatre with waiver of: SECTION 18.52.060(3)~B) - Required block wall surroo;:dir,q outdoor uses, (Sir:-foot maso~ry wall required; none proposed) 2, Th•,t Waiver 1-a, above mentioned, is hereby granted on the basis that the use has been ir. existence for a nuin~er of years with rtw_tal fencing, and the expansion proposed would be to divide the existing ~se to proJect two screens. 3, That the proposed use will not edvecsely effect. the adjoi:~ing land uses end the gcowth and development of the erea in which it is proposed to be located. L~,, Thet the size end shape of the site proposed for the use is edequete to allow the full devetopment oE the proposed use in a manner not detrimental to the parficular area nor to the peace, health, safety, and general welfare of the Citiaens of the City of Aneheim. 5, That the granting of the Conditinnal Use Pecmit under the conditions imposed, if nny, will not be detrimental to the peace, health, safety, end general welfara oE the Citizene of the City of Anaheim. 6. That the petitioner stipulated that ~o "X-rated" films would bc: shown. 7. That the petitior.er stipulated to the plarting of trees at the rear of the new picture screen to shield the rear of the screen from view from the street and freeway. 8. That the petitioner stipulatad that redwood slats would be provided in the chaiZ- link, and that redwood slats were readily available. NOW, THEREFORE, BE IT RES~ ED that the AnahEim City Plann~g Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions whicfi are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of ths Citizens of the City of Anaheim: (1) That the owner(s) of subject property shall obtain clearance from the State of Calif- ornia, Division of Highways that lights from cars within the theatre will not interfere with freeway traffic. (2) That the :;idewalks sh~ll be installed along Lemon Street as require~ ~y the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. (3) That street lighting facilities along Lemon Street shall be installed as required by the Director of Public Utilities and in accordance with standard plans and sper.ifications on file in the office of the Director of Public Utilities, and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the instal- lation of the above me~tioned requirements. (4) That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. (5) That fire hydrants shall be installed and charged as required and determined to be necessary by the Ch+ef of the Fire Department. (6) That subject property srall be served by undergro~nd utillties. (7) That drainage of s~bjecs property shall be disposed of in a marne~^ that is sat?~~act- ory to the City Engineer. (8) That any metal struct~res or walls shall be developed in accordance with the City Council Mstal Building Policy. (g) That redwood slats shall be installed in the chainlink fence surrounding subject property, as stipulated to by the petitioner; and that if redwood slats are not available, metal slats will not be permitted. (iC) That subject property shall be developed substantiaily in accordance with plans and spe~ifications on file with the City of Anaheim marked Exhibit No. 1, provided however, that trees shall be planted adjacent to the rear of the new movie screen to shield the rear of the scree~ from view from the freeway, as stipulated to by the petitioner. (11) That Condition Nos. 1 and 3, ~bove mentioned, shall be complied wiih prior to the commencement of the activity a~thorized under this resolution, or pr~or to the time that the building pe~mit is issued, or ~vithin a period of one year from the date hereof, whichever occurs first, or such further time as ±he Planning Commission may grant. (12) That Cond?tion Nos. 2, 4, 5, 6, 7, 8, 9 and i0, above mentioned, shall be complied with prior to final building and zoning inspections. (13) That no "X-rated" filns shall be projected on the screens of subject property, as stipulated to by the petitio~er.
