PC 73-195~ * ~ ~ ~ RESOLUTION N0. PC73-195 A RESOLUTION OF THE CITY PLANNING COMMISSTON OF TIIE CITY OP AN9HEIM AMENDING CONDITIONS OF RESOLUTION N0. PC72-308, THERETO WHEREAS, on October 21, 1969, the City Council approved a resolution of ir_tent to establish C-1, GENERAL COMMERCIAL, 20NE for Reclassification No. 69-70-17, subject to con- ditions, and in conjunction with Condtti.ona7. Use Permit No. 1135, to construct a wedical office building; and WHEREAS, subsequent to the approval of Reclassification No. 69-70-17 and Condition.al Use Permit No. 1135, a condominium commercial office building was proposed and approved, sdbject to conditions, with private recreationai facilities under Conditional Use Permit ' No. 1356 rather than the proposal under Conditional Use Permit No. 1135; and WHER~AS, at said public ~.~earing the developers indicated that since air space would be sold Within the building ~n an "as needed" basis, it would be extremely difficult to know the limits of the vari~~us air space modules until they were actually sold; and WHEREAS, altliough thi> was understood by the Planning Co~tission, the conditions of approval; namely,Condition ;vos. 2(a) and 2(b), 16, and 17 were not structured to accomplish this end; and WH~R~AS, a letter fias been submitted by the developer requesting modification of the aforementioned conditicns in which Condition No. 2(a; would be complied with prior to the commencement of the ac'tivity authorized, while Condition No. 2(b) would bP co;aplied with prior to final buildit.g and zoning inspections; and WHEREAS, representatives of the Engineer9.ng Divi.sion, City Attorney's Office and Dev- elopment Services Department examined the proposed amendments and concluded that these, amendments would not be detrimental to the interests of the City of Anaheim. NOW, TAEREFORE, BE TT RESOLVED that the Anaheim City Planning Commission does hereby adopt amendments to Resolution No. PC72-308 granting Conditional Use Permit No. 1356 as follows: "(~?a. That a tentative tract map of subject properYy shall be submitted to and approved by the City Council. (2)b. That the final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. (16) That Condition Nos.l and 2a, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is iasued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. (17) That Condition Noc. ?h, 3a, 3b, 4, 6, 8, 9, 10, 17., 12, and 14 shall be com- plied with prior to final building and zoning inspections."
