A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM

WHEREAS, the Ciiy Planning Commission of the City of Anaheim did receive a verified Petition for Conditional
lise Permitfrom DO(iNID E, PIEROTTI, 501 St. John Way, PlacentGa, California 92670; WE•SL•EY
COLLIER, 18111 East Orangethorpe Avenue, Anaheim, Californiia 92805; DIERK D. PETERS,
500 West Grove Avenue, Orange, Galifornia 92665, Owners; K E Z Y RADIO, attention of
Harris H. Thomson, 9190 East Bail Road, Anaheim, California 92805, Agent of certain real
property situated in the City of Anaheim, County of Orange, State of California as des-
cribed in Exhibit "A" attached herato and referred to herein as though set for•th in fu11
; and
WHEREAS, the City, Plenning Commission did hold a public hearing at the City Hell in the City of Aneheim on
September 5, 1973 o at 2:00 o'clock P.M., notice oE said public hearing having been duly given as required by
law and in accordance with the pcovisions of the Anaheim Municipal code, Chspter 18.64, to hear and consider evidence
for and egair.st said pcoposed conditional use and to investigate and make Eindings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation, end study made by itself end in its behalf, and
aiter due consideration of all evidence and ceports offered at said heering, does Eind end determine the following facts:
1. Thet the proposed use is properly one for which a Canditionel Use Permit is uuthorized by Code Sectioxi
18.64.020(3-s) to wit: install radio transmission towers and trat~smitter unit.
2. That the proposed use will nut adversely affect.the adjoining lend uses end the growth end development oE
the area in which it is proposed to be located.
3, Thet the size and shape of the site proposed foc the use is adequete to allow the full development of the
pmpo~ed use in e manner not detrimentel to the particular area nor to the peace, health, safety, end generai welfare ot
the Citizens ofthe City of Anaheim.
4. That the granting ot the Conditionel Use Permit under the conditions imposed, if any, will not be detrimentol
to lhe peace, health, safety, end genewl welfare oE the Citizens of the City of Mahein:.
5. That development of the property for esrculation and access as required under
Area Development Plan No, 102, can only be accomplished at auch time as the properties to
the south and east are ready for development and at auch time, theh street improven~ents
can be completed.
EINIRONMENTAL IMPACT REPORT FINDING:
That ehe Planning Commission, in connection wiCh an Exem.ption Declaration Stacus request,
finds and determines that the proposal would ka:~ no signifil~nt environwental impact and,
therefore, recommends to the Cil•y Council that no ~nvironmental Impact Statement "ss necessary.

NOW, THEI2EFORE, BE IT RESOLVED thet the Aneheim Ci!y Plenning Commission does hereby grant subjeet
Petition for Conditior.el Use Permit, upon the tollowing conditions which are hereby found to be e necessery prerequisite
to the proposed use of the subject property in order to presecve the sufety and genera( welfare of the Citizens of the
City of Anaheim:
(1) That the owner of subject property shall conditionally dedicate the mest easterly
32 feet of subject property to the City of Anaheim for street and public utility purposes in
accordance with Area Development Plan No. 102, conditioned upon the need for access to the
street by other properties in the area and upon demand by the City of Anaheim.
(2) That the owner shall post a bond or a letter of credit ~rith the City of Anaheim in
an amount and form satisfactory to the City of Anaheim to guarantee the insCallation of all
engineering requiremenCs of the City along the new street, sucP~ as curbs and gutters, side-
walk, street grading and paving, drainage £acilities and other appurtenant work.
(3) That fire nydrants ahall be installed and charged as required and determined to be
necessary by the Chief of the Fire Department prior to commencement of structural framing.
(4) That subject property shall be served by underground utilities.
(5j That this Conditional Use Permit is granted subject to the completion of Reclassi-
fication No. 70-71-5, now pending.
(6) That drainage of subject property sliall be disposed of in a manner tha~ is satis-
factory to the City Engineer.
(7) That suUject property shall be developed substantially in conformance with plans
and specifications on file with the City of Anaheim, marked Exhibit N~. 1.
(8) That Condition Nos. 1, 2 and 5, above mentioned, shall be complied with prior to
the commencement of the activity authorized under thie resolution, or prior to the time
that Che building permit is issued, or wlthin a period of one year from date hereof., which-
ever occurs firsC, or such further time ~ae the Planning Commission may grant.
(9) That Condition Nos. 4, 6, and 7, above mentioned, shall be complied with prior
to final building and zoning inspections.
