That the petitioner stipulated to providing a 6-foot wide landscape buffer strip adjacent to the 6-foot masonry wall proposed on the south side of the accesswsy separating subject properCy from the R-A parcel to the south, -1- ,. " ~ ~ 5. That the propcsed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 6. That the size and shape of the site proposed for the u~e is adequate to allaw the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Aaaheim, 7. That the granting of the Conditional Use Permit under the corditions imposed, if any, will not be detrimental to the peace, health, safety, and general t~elfare of Che Citi- zens of the City of Anaheim, S. That two persons appeared in opposition, ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission finds and determ3nes that the proposal would ha~e no signi- ficant environmental impact and, therefore. recommends to the City Council toat Exemption Declaration Status be granted, NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Perrnit, upoti the following conditions which are hereby found to be arecessary prerequisite ro the proposed use of the subject property in order to preserve the safety and general welfare of ihe Citizens of the City of Anaheim: (1) That a final t:act map of subject ~roperty ~hall be submitted to and approved by the City Council snd then be recorded in the office of t.he Orange County Recorder. (2) That this Conditianal Use Permit is granted subject to the completion of Reclassi- fication No. 68-69-85, now pending. (3) Tliat prior to filing the final tract map, the applicant shall submit to the City Attorney for approval or denial a complete synops-~s of Che praposed functionir.c; of the operating corporation including, but not limited to, the articles of incorporation bylaws, proposed methods of management, bonding to insure maintenance of common property and build- ings, and such other information as the City Attorney may desire to protect the City, its citizens, and the purchasers of the project, (4) That the covenants, conditions and restrictions shall be submitted to and ap- proved by the City Attorney°s of.fice prior to City Council approval of the final tract map and, further, that the approved covenants, conditions and restrictions shall be record- ed concurrently with the final tract map. (5) That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. (6) That fire hydrants shall be installed and charged as required and determi.ned to be necessary by the Chief of the Pire Department prior to commencement of structural fram- ing, (7) That all air conditioning facilities sha11 be properly shielded from view, and the sound buffered from adjacent property, (8) Thst all lots within this tract shall be served by underground utilities. (9) That the owner(s) of subject property shall pay to the City of Anaheim the ap- propsiate Park and Recreation in-lieu fees as determiued to be appropriate by the City Council, sai~ fees to Ue paid at the time the building permit is issued. (10) That subject property sha11 be devexoped substantially i.n conformance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, and 13; provided, however, that the square footage of the floor areas sha11 be in conformance with the square footage as depicted on Exhibit No. 1; and further provided that a 6-foot landscape buffer strip including irrigation facilities, proposed to be adjacent to the reqaired 6-foot masonry wall, shall be provided on the south side of the accessway from Nutwood Street separating the R-A parcel from the azcessway. Land- scaping plans to be submitted to and subject to ~he approval of the Development Services Department; and that provision ehali be made for perpetual maintenance of said landscaping, as stipulated to by the petitioner, RESOLUTION N0. PC73-2 '2" (_~ ~ ~ (11) That Conditio^ Nos. 1, 3 and 4, sbove mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from dat~ hereof, which- ever occurs first, or such furtt~er time as the Planning Commission may grant. (12) That Condition Nos, 5, 7, 8 and 10, above mentioned, shall be complied with prior to final building and zoning inspections.
