That Waiver 1-c, above mentioned, is'hereby granted•on the bas~is that'the petition- er is the owner of the adjacent parc~l, and proposes to develop it for inudstrial purposes. 4, That Waiver 1-b, above mentioned, is granted in part waiving the Katella Avenue 10-foot minimum required se:back to permit 3 feet, on the basis that the slope and below grade level location of Katella Avenue was adequate setback, since said slope havin9 been dedicated to the City of Anaheim is fully landscaped; however, waiver of the 10- foot setback along Howell Street is hereby denied since revised plans indicate a 10- foot landscape st'rip. 5: That Waiver 1-e and 1-f, above mentioned, is hereby granted because of the con- figuration of the preperty, sign location and identification of the property would be extremely difficult due to the slope along Katella Avenue. 6. That Wai~er 1-f, above mentioned, is hereby granted on the basis that the.use of the property is classified as a C-3 use and the size sign would be permitted in said zone. 7. That th~ proposed use as granted will not adversely affect the adjoining land uses and tfie growth and development of the area in which it is proposed to be located, S. That ehe size a~~d shap~ of the site proposed for the use is adequate to allow the full development of xhe proposed use as 9ranted in a manner not detrimental to the par•ticular area nor to the peace., health, safety, and general welfare of the Citizens of the CiYy of Ana~eim. 9. NQ~,PT~~iF~R~FORE, BE IT RESOLVED that the Anaheim City Planning f.ommission does hereby grant/subject'Petition Tor Conditional Use Permit, upon the following conditions which ar~ hereby found to be a necessary prerequisite to the proposed use of the subject pro- perty in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: (1) That the o::ner(s) of subject property shiall deed to the City of Anaheim a strip of land 45 fee:, ~n width from the centerline of the street along Howell Avenue for street widenin9.pur•poses: (2) That all en9ineering requirements of the City of Anaheim along Howell Ave~tue, i~cluding preparation of improvement plans and installaticn of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as i•zquired by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Howell Avenue shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the Ci~y of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. (3) That Che owner(s) of subject property shall Qay to the City of Anaheim the sum of 60t per front foot along Howell Avenue for tree planting purposes. (4) That trash storage areas shall be provided in accordance with approved plens on file with the office of the Director of Public Works. (5) That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fi!-e Departm~nt pYi~or to ~ommencement of structural framing. '', ~ ~ ' " ' (7) That a parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be record;;d in the office of the Orange County Recorder. (8) That subject property shall be served by underground utilities. (9) That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer, (10) That the final parking plan shall be approved by the Gevelopment Services Department and any landscapad areas in the parking area shall be protected with 6-inch high, concrete curbs, and concrete wheel stops shall be provided for parking spaces., (11) That subject property sh~ll be developed substantially in accordance with plans and specifications on file with the City of Anaheim mark.ed Exhibit Nos. 1, (Revision No. 1) 2, and 3. (12) That Condition Nos. 1, 2, 3, and ~, above mentioried, shall be complied with . prior to the commencement of the ar,tivity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. (13) That Condition Nos. 4, 6, 8, 9, 10, and 11. above'mentioned, shall be com- plied with prior to final buildin9 and zoning inspections.
