PC73-230 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2555 BE GRANTED WHEREAS, the City Planning Commission o£ the City of Aneheim did receive a verified Petition for Verience f:om DONALD T, AND GERALDINE M. WOODS, 316 Bayport Circle, ApBrtmeat A, Anaheim, Califor- n.ia 92801, Owners; RICHARD ?~. FINGAL, 1510 Harle Place, Anaheim, California 92802, Agent of certain real property situated in the City of Ai~aheim, County of Orange, State of Cali- fornis, described as Lot 27 of Tract 5~27, as per Map recorded in Book 209, Pages 30, 31 and 32, Miscellaneous Maps, in the office of the County Recorder of ~aid county ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in ~he City of Aneheim on October 15, 1973 at 2:00 o'clock P.M., notice of said public heacing having been duly given as required by la~v and in eccordnnce with the provisions of the Meheim Municipal Code, Chapter 18.68,to hear and consider evi- dence :or end against said proposed veriance and to investigate end meke findings and rernmmendetions in connection therewith; and WH~REAS, seid Commission, efter due inspection, inveskigation, end study mede by itself and in its behalf, end after due rnnsideration of ell evidence and repocts offered at said hearing, does Eind end detecmine the following fecks: 1. That the petitioner requests variances from the Anaheim Municipal Code as follows to construct a single family residence: a. SECTION 18.20.030(2-a) - Side vard setbacl:. (10% of the lot widtti to ten-foot maximum required; eiKht feet proposed) b. SECTION 18.20.030(3-a) - Rear yard setback. (25 feet required; 17 feet proposed) 2. That the:e are exceptional or extreardinery circumstances or r.onditions epplicable to the property invelved or to the intended use of the property that 2o not epply generally to the prope:ty or cless of usc. ~n the same vicinity and zone. '. 3. That the requested varience is necessery for the pteservation end enjoyment of e substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. Thet the requested varience will not be muterially detrimental to the public welfare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. ENVIROh1MENTAL IMPACT REPORT FINDING: That the Planning Commission, in connecti~n with an Exemption Declaration Status request, finds and determines that the proposal. would have no significant environmental impact and, therefore, recommends to ti~e City Council that nc c;nvirc~nmental Impsct Statement is necessary. Vl-G , _1_ DEV-66•C ~~ ~ ~ NOW, THEREFORE, BE I'f RESOLVED thet the Anaheim City Planning Commission does hereby grant subject Petition for Varience, upon the following conditions whish are heceby found to be a necessary prerequisite to the pro- posed use of the subject property in ocder to preserve the safety end general welfare of the Citizens of the City of Anaheim: (1) That subject property sha1Z be served by underground utilities. (2) That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. (3) That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. (4) That Condition Nos. 1, 2, and 3, abo~e mentioned, shall be complied wfth prior to final building and zoning inspections.
