DARGATZ, 2624 Ptatmigan Drive, Dio. 4, Walnut Creek, California 94595, Owaer; DON J, CARSON, 4332 East La Palma Avenue, Analzeim, C~lifornia 92807, Agent of cer- tain real property-situated in the City of Anaheim, County of Orange, State of California, °@~lscribed as ~ot 8 in Block 11 of the "Golden 5tal•e Tract", as per map thereof recorded in book 4, aages 66 and 67, hiiscellaneous Maps, records of said Orange County. EXCEPTING TIiERE- PROM that portion thereof cer.veyed to the State of California by deed recorded N.arch 24, 1964: in booic 6974, page 105, Official Records ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim on October 15; 1973, nt 2:00 o'clock P.M., notice of said public hea:ing having been duly given as required by law end in accordence with the provisions of the Maheim Municipel Code, Chep~ar 18.68, to hear and consider evi- dence for and.ag~inst said proposed variance and to investigate and.meke findings end recommendations in connection therewiih; and . WHEREAS, said Commission, efter due inspection, investigr~tion, and study. made by itself and in its behalf, and aFter due rnnsideration of all evidence and reports offered at said hearing, does find and deteanine the following facts: 1. That the petitioner stipul3ted shieldi,r.~ ~aould be constructed to obscure from view two larye dust collection bag units located on the south side of the proposed buildiitg; said shielding to be constructed of 2-inch x 12-inch redwood or cedar louvers. Vl-G , ' ~ _1~ DEV-66•C ENVIRDNMENTAL IMPACT REPORT ~ING: ~ That the Planning Commission in connectiori with the filin9 of Environmental Impa~t Report No. 102 fi~ds and determines that the Environmental Impact Report is adequate as an inf~r- mative document and follows the City's established guidelines, and that there would be no significant advsrse environmental impacts; and, therefore, the Planning Commission recommends to the City Council that said report be adopted as the Council~s Environmental Impact State- m:nt. ' NOW, THEREFORE, BE IT RESOLVED that the Anahe?m City Plannitig Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in o~der to pre- serve the safety ~nd general welfare of the.Citizens of the City of Anaheim: (1) Thr:t this Variance is granted subject to the completion of Reclassification No. 66-67-25(3), now pending. (2) That the owner(s) of subject property shall deed to the City of Anaheim a strip of land 32 feet in width from rhe centeriine of the street along Coronado Street for street widening purposes. (3) That all engineering requirements of the City of Nnaheim, along Coronado Street including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant . work shall be complied ~tith as required by the City Engineer and in accordance with standard plans a~d specificatiuns,•on file in the office of the City Engineer; and that a bond in an amount and form satisfisctory to the City of Anaheim shall be posted with *he City to guarantee the instatlation o~-the above mentioned requirements. (4) That the owner(s) of subject property shall pay tothe City of Anaheim the sum of $2.00 per front foot along Coronado Street for street lighting purposes. ~ (5) That trash storage areas shall be provided in accordance with approved plans•on file ~aith the office ef the Director of Public Works. (6) That fire hydrants shall be installed and r.harged as required and dete.rmined to be ne:.essary by the Chief of the Fire Department prior to commencement of structural framing. (7) That all air conditioning facilities shall be properly shielded from view and the sound buffered from adjacent properties, (8) That subject prope~ty shall be served by und~rground utilities. (9) That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. (10) That appropriate water assessment.fees as determined by the Director of Public Utilities shail be paid to the City of Anaheim prior to the issuance of a building permit. (11) That the final parking plan shall be approved by the Development Services Depart- ment, and any landacaped areas in the parking areas shall be protected with six-inch high concrete curbs, and concrete wheel sto~5 shall be provid~d for parking spaces. (12) That shielding shall b~ cortstructed to obscure from view two large dust collection bag unit9 located on the south side of the proposed building; said shielding to be constructed of 7_-inch x 12-inch redwood lcuvers, or in the event redwood is not available, cedar may be substituted, as sfipulated 6y the petitioner and in accordance with spec?fic plans as submitted. (13) That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, and 3, (14) Tha~ Condition Nos. 1, 2, 3 and 4, above mentioned, shall be complied with prior to the commencement of the activity authorized under th~s resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, which- ever occurs first, or such further time as the Planning Commission may grant. ~ (15) That Condition Nos. 5; 7, 8. 9, 11 and 13~ ~bove mentioned, shall be comp]ied with '. prior to final building and zonirig inspections.
