That the petitioner requests a varience fcom the Aneheim Municipal Code: a. SECTION 18,52.020 - Permi.tted uses, (Retail display and sales facility not permitted; retail display and sales facility proposed) b. SECTION 18.52.060(4) - Minimum required parking. (30 spaces required; 15 spaces proposed) 2. That thece are exceptional or extcaocdinary circumstances or conditions applicable to the property involved or to the intended use of the property thak do not apply genecallp to the property or class of use in the same vicinity and zone. 3. That the cequested variance is necessary for the preservation and enjoyment of a substantiel pmperty right possessed by other property in the same vicinity and zone, and deniru to the propecty in question. 4. Tl~at the requested variance will not be materially detrimental to the public welfare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 5. That due to the fact that the use proposed is retail sales on a limited basis and has never been prespnted to the City before, iC shuuld be granted for a period of one year to determine. whether any adverse eEfects will result, particulatly since the petitioner stated that he had a one-year lease oci L•he property, and whether this use would establish an undesir~ble precedent tor similar requests for the industrial areas of the City of Anaheim. . -1- __......._._._.__ _. . . .. . . ---~ _ ENVIRONMENTAL IMPACT ?tEPORT FINDING: Thpt the Planning Commiss•lon, in connection with an Exemption Deciaration Status requ4st, finds and detetmines that the proposal wou?d have no significant environmental impact~and, therefore, recommends to the Cit} Council that no Environmental Tmpact Statement is neces- sary. NOW,THEREFORE, 3E IT RESOLVED that the ~rraheim City Planning Commission does hereby grant subject Petition for Variance, upon the ~ollowing conditions :~hich are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to pre~erve the safety and general welfare of the Citf.zens of the City o£ Anaheim: (1) That subject property shall be developed substantia~.ly in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. (2) That in order to deteLmine whether any adverse effec't will result irom the granting aaiver of~the parking and the proposed use, the Planning Cocmaission grants a one-year time limitation, after which time consideration may be given to whether the waiver of the use and required parking should be extended.
