A RESOLUTIOHAT ETl ION OR VAR AN E~~ S10 ~05 ~E GRANT DA IN ART WEIEREAS, the City Planning Commission of the City of Maheim did receive a verified Petition for Variance from ANP,HEIM HILLS, INCORPORATED, AND TEXACO VENTURES, INCORPORATED, Attention of James Barisic, 380 Anaheim Hills Road, Anaheim, California 92806, O~mer of certain real property situated in the City of Anaheim, County of Orange, State of California,~ias'described in Exhibit "A" attached hereto and referred to herein as though set forth in full; and L WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on ' Febr.uary 21, 1973, at 2:00 o'clock p.m., no6ce of said pablic hearing having been duly given as required by law and in accordance with the'provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidenco ;or and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Comrt~ission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. (60 Feet required; lot widths ranging to a minimum of 15 feet proposed) e. SECTION 18.04.075 - Re uirement that a lot shall not side or front onto an arterial street, (2 side-on and 3 front-on lots proposed) 2. That Waiver 1-a, above mentioned, is hereby denied on the basis that the petitioner atipulated to complying with setbacks presently being revised by the City Council, wherein garage setbacks shall be either 25 feet or 6-10 feet, providPd that the garages on the 6-10 foot setbacks have automatic garage door openers. ~. That Waivers 1-b, 1-c, and 1-d, above mentioned, are hereby granted on the basis that the hillside topography jusCifies deviations from the "flatland" development standards as delineated in the R-1 Zone. 4. That there are exceptional or extraordinary circumstances or conditions applicable to the p'roperty involved or to the intended use of the property that do not apply generally to the property o`r class of use in the satine vicinity and zone. 6. That the requested variance is nec~ssary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 7. Tnat the requested variance will noC be materially detrimental to the public wel- fare or injurious to the property or improvements in such vicinity and zone in which the prop- erty is located. 8. That the petitioner stipulated to preparation of an instruction booklet regarding grading and maintenance of landscnping as~well as controlled waterinb of the slopes. 9. That the petitioner stipulated to providing special house plans for Lot Nos. 34, 35, and 36 of Tract No. 8215, in order that adequate setbaaka are,~~ovided by taking advantage ef the terrain, building one-story on the flat pad and two-story to the rear ori the slope. 10. That the petitioner stipulated to including in the Covenents, Restrictions and Conditions of Tract Nos. 8215 and 8219, the provision that no fences shall be constructed on the slopes of the lots facing Anaheim Hills Golf Course. ENVIRONMENTAL IMPACT REPORT F7NDING:. That the petitioner has submitted Environmental Impact Report No. S~ in conjunction with Variance No. 2475, said E,I.R, tihving been reviewed by the E.I.R. Review Committee as set forth in their reporC; therefore, the Anaheim Plenning Co~nission recommends to the City Council that Environmental Impact Report No. SP~ be adopted as the City Council's Environ- mental Impact Statement. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plann3ng Commission does hereby grant in psrt subject Petition for Variance, upon Che.following conditions which are hereby found to be a necessary prerequisite t,o the proposed use af the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: (1) That thia veriance ia granted subject'Co completion of annexation of affected portions of subject property to the City of Anaheim~ and the completion of Reclassification No. 71-72-44 and Tentative Map of Tract Nos. 8215 and 8219. (2) That subject properCy shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1 provided, however, that final specific•plans sha:l be submitted and approved in accordance with provisions of the PC, Planned Community, Zone prior to the Approval of the final tract maps. (3) That all structures to be developed on subject property shall comply with the requLred 25-foot f.ront aetback ptovided~.howevery that setbacks for garages may be reduced to 6 to 10 feet if automatic garage door openera.are inatalled with said garages. Garages without automatic garage door openera phall' be aet back a minimum of 25 feet from the front property line. (4) That prior to the sale of Lo.C No. 40 of Tract No. 8219 or any street impr.ovement proposed, said lot shall be annexed to Che City of Anaheim. (5) That special brochures ehall be prepared for purpoaes of instructing proapective purchasers of these homes on the proper maintenence and watering of landscaped slopes, as stipulated to by the petitioner. (6) Thae the developer shall include in the Covenents, Restrictions, and Conditions of TracC Nos. 8215 and 8219, the provision that no fences shall be censtructed on the slopes of the lots facing Anaheim Hills Golf Course, as stipulated to by the developer.
