PC73-44 A RESOLUTION OF THE CITY PLANNING CO~AfISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL THE ABOPTION OF AN ORDINANCE AMENDING THE P(", PI,FNNED COMMUNITF, ZONE ON AN ZNTERIM BASIS ONLY , WHEREAS, subsequent to the adoption of the PC, PLANNED COMMUNITY, ZONE, the City AttorneY expressed concern regarding the legality and enforcement of certain portions of the existing PC Zone; and WHEREAS, the City Attorney was of the opinion that.the PC Zone should be amended to include two major sections; namely, the requirement of a zoning plan or element and that planned residential development should all be considered under a conditional use permit; and WHEREAS, the City Planning Commission did.hold pubTic.hearings at the City Hall in the City of Anaheiin on'Augu5t 7, August 21, September 18, 1972, and January 8:and~January P2~ 1973, at Z:O~ o°clock p.m., notice of said public hearin~ having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said proposed amendnients and to investigate and cuake findings and recommendations iri connection'Eherewith; and ~ I ?HEREAS, ssi3 Commissioni after due inspection, investigation, and atudy made by it- self and in its behalf, and after due consideration of all evidence and reports offered at said hearings, does find and determine the following facts; 1. That the City Attorney has ruled that acCion would have to be taken on the PC Zone amendments since a number of zoning actions were dependene on the requirements of the PC, PLANNED COMMUNITY, ZONE. 2: That the Planning Commission deemed it necessary to have hillside zonea for development of the property in the Anaheim Hills. 3. That hillside zones were presently being dra£ted for future consideration a~ public hearings by the Planning Commission. 4. That the Planning Commission was reluctant to take any action on the PC Zone and would recommend to the City Council that no-actton be taken, however, if the City Council determines that action be taken,said action should be on an interim basis, so that the hillside zones now being drafted would become effective upon adoption, and which would compl~ment the PC Zone making it a more eEfective zone in which to develop. NOW, TH~REFORE, BE IT RESOLVED that the Anaheim City Planning Ca~ission does hereby recommend to the City Council af the City of Anaheim that amendments to L•he PC, PLANNED COh¢IUNLTY~ ZONE as depicted on Exhibit "A" not be adopted, BE IT PURTFIER RCSOLVED that if the Anaheim City Council determines that the PC, PLA:a'NED COPII'NNITY, ZpNE amendments should be adapted, then the Planning Commission of the City of Anaheim would recommend that they be adopted an an interi~ basis only, until such Cime as hillside zones h~ve been drafted and recommended .f.or adoption by the Planning Commission of the City of Anaheim. COht~un I TY ZON i hG PXEi2P,:PP "A" SECTION 18.57.010 - PC PLANNED COMMUNITY ZUNING OESCRIPTION AND PURPOSE (i) The purpose of Planned Lommunity Zoning is to encourage, preserve and improve the health, safety and general welfare of the people residing within the community by encouraging the use of contemporary land planning principles• The provisions of this zone are intended to allow diversification of uses, relation- ships and heights of buildings and open spaces in planned building groups while insuring compliance with the spirit, intant and other provisions of tha zcning ordinance, (2) To utilize Planned Cor~munity Zoning, an area shall be of sufficient acreage to be suitable for development as described in the De~cription and Purp~se of this zone. ~urthermore, said area shall be under single ownership or controlled by a single ent?ty at the time of application and until the effe~- tive date of Che ordinance app-oving :tie proposed Gence~al Plar of Development (3) Contiguous land may be added to an existing Planned Community providec~ said land is made a part of the General Plan of Development as hereinafter pro- vided. Contiguous shall mean having a common boundary with the prope~ty to which it is to be added or shall mean that the property is so physically iocated that in the opinion of the City Council, after review of a recommendation by the Planning Commission said additional area bears a significant relationship to the approved and adopted General Plan of Gevelopment• SECTION 18.57.020 - PROCEDURE FOR UTILIZING PLANNED COMMUNITY ZONING AND THE GEDJERAL PLAN OF DEVELOPMENT The applicant for PC Zoning shall, prio~ to'acceptance of his petit~on by the City submit a General Plan of Development for review by the Interdepartmen[al Committee. Said 6enarai Plan of Development shall consist of maps, statements of goals and objectives and proposed land uses and shall i~clude the followi~+9 elements: (}) Land Use and Housing Element (2) Circulation Element (3) Population Elemenl (4) Services and Facilities Element • (5) Zoning Plan or Element ' SECTION 18.57•02~ - LAND USE AND HOUSIN6 ELEMENT The land use element shall consist of maps setting forth the distribution, general location and extent of the areas of land devoted to each category of land use proposed as part of the Gxneral Plan of Development. For example, the land use and housing map might inc~ude designations for various housing types, i.e., one-family, multiple-family, condominiums, cluster or row dwellings, etc „ neighborhood retail shopping facilities, community retail shopping facilities, regional retail shopping facilities; office facilities, service facilities, education, religious, recreation, public and semi-public facilities, conserva- tion or open space areas, or other categories of public or private uses of land. SECTION 18.57•022 - CIRCULATION ELEMEPIT The Circulation element shall consist of maps setti~g forth the general locations and width of arterial highways and extent of all transportation facilities proposed as part of the General Plan of Development. This element shall include basic design criteria for engineering review and the traffic carrying capacities of all arterial streets and highways. The circulation element may be shown as part of the'land use map. Nothing herein is to be con- strued as to require the delineation of local streets on the circulation element . ., ~ ~ ~ -z- sir.ce such street orientation is subject to development design and topography. Al1 major, primary, secondary and collector street networks shall be in sub- stantial conformance with the circulatior. element of the Anaheim General Plan. 5EC'CION 18.$7•023 - POPULATION eLEMENT The populatior, element shall contain a statement of dwelling unit density for rhe entire planned commun~ty as well as for the individual planning areas. SECT!ON 'i8.57•024 - Sr.RVICES AND FACILITIES ELEMENT The sesvices and facil+ties element shall contain maps setting forth the general location of ar,y ard all existing ard proposed backbone systems for sewerage, water, and drainage facilities. SECTION 18.57.~Z5 - ZONIN6 PLAN OR ELEMENT The zoning plan or element shali designate the City of Anaheim zoning that is to be employed in imp!ementir,g the Planned Community and shall be accom- panied by any necessary maps or descriptions. , Planned Residential Housing DevelopmenCS which comply with the land use and zoning proposals and population densities set forth on the General Plan may be approved by conditional use permit. Where other types of development can not be adequately provided for under the zonir.g plan or element, due to terrain, size and shape of the property, etc., the City would have the option of approving a variance. SECTION 18.57.026 - ADDITIONAL ELEMEN?5 AND SUPPORT DATA The General Plan of Deveiopment may include any additional elements con- sidered necessary for the physical development of the Plan~ed Community or to aid in evaluating the impact and erfect on other existir.g or proposed facilities and services of the City. The Generai Plan of Deveiopment shall include supporting maps, data and explanations of the method utilized in its formulation, a~d shall be the basis on which the Planned Community Zoning and final specific plans shall be evaluated. SECTION 18.57.030 - METHOD OF ADOPTION OF TNE GENERAL PLAN OF DEVELOPMENT (1) Public notice of the hearing on the General Plan of Development shall be incorporated into the public notice for Planned Commur.ity zoning. (2) The General Plan of Development may be approved, modified, condi- tionally app~oved or rejected by'the Planning Commission or City Council. PC Zoning may be accomplished upon adoption of the General Plan of Development. SECTION 18.57.031 - AMENDMENT TO THE GENERAL PLAN OF DEVELOPMENT Any amendment to the adopted 6eneral Plan cf Developmer~t shall proceed as outiined in Paragraph 18.57•030, captioned '~Method of Adoption of the General Plan of Uevelopment." 0 -3- SECTION 18.57.040 - FINAL SPECIFIC PLANS ~ ~ Prior to the introduction of an ordirence establishing zoning within a Planned Community on a specifrc parcel or parcels, L'here shall be submitted to the City of Anaheim two (2) complete sets of final specific plans for each phase of development or po~tYon thereof for which permits are tu be requested o~ -equired. Final Specific Plans. Finai specific plans shall include but not be limited to: (1) Location map drawn to the same scale as the map of the adopted Gene-al Plan of Development relating site plan to ~he approved Gene^al Plan of Development. Said locational map. shall include a legal description of the p~operty upon which the Finai Specific Pla~ is filed. (2) The placement of buildings and structures, front, side, and rear elevations. (3) Lot dimensions and pad size of all lots sufficient to indicate the relationsh~p of the proposal to the nature a~d extent of the cut and fill or earthwork involved. (4) Off-street parking and vehicie storage. (5) Fxtent and type of landscaping proposed including any existing vegetation. (6) Topographic map. (7) Public and p~ivete streets, public alleys o- private accessways used for vehicular circulation. (8) Type of fencing along ary lot line of a s~te abutting a street, river, creek, open storm dra.in, lake, railroad, or other works, SECTION 18.57.042 - FINAL SPECIFIC PLAN PROCESSING FEE The applicant shall be required to pay appropr?ate fees for the processing of any and all final specific plans. SECTION 18.57.044 - APPROVAL OF FlNAL SPECIFIC PLANS The Anaheim Planning Commission shall approve all final specific plans in the Planned Community. The Planning Commission shall consider each request to insure that the proposed improvements will meet the purpose and intent and development standards and regulations established fo~ the Planned Community, The decision shali be subject to appeal in the same manner as conditional use permits and variances. SECTION 18.57.050 - RECLASSIFICATION FROM PC ZONING Any application for reclassificationfrom the PC Zoning to any other zone tfiat was not approvetl as part of the zoning for a Planned Community shall be deemed to be an amendment to the adopted General Plan of Devefopment. $aid application shall be processed as prescribed in the paragraph captioned "Amendment to the General Plan of Development". . f .. h ~ ~ ~ ~ ~ SECTtON 18.57.060 - DEDICATION i\ND IMPROVEMENTS Ant?c~p~ti~a that ::hanges will occur in the area due to the increase in veMicular traffic, the following dedications and improvemsnts are deemed to be necessary to prevent congestion ar~d the othe: hazards related to the inten- sified t;se of the lard,and to be necessary for the preservation of the public health, safety and general welfare. These requirements shall be met or complied with before any complex or building shall be given final app~oval a~d accepted ~ror use and occupancy: (1) Ali required arte'ial streets and highways, iocal streets, and alleys, wh~ch abut the subject propert.y, shall +~e dedicated to the full width desig- nated by the Anaheim Gene-al Pian or otha- officiai p~ans or sta~dards adopted by the City Cou~cil. (~) All -equired streets, highways, alleys, or other circulation fac+lities wh~ch abut the subject p'oparty shall have been ir,stalled and ir? good repa:r. A faithful pesfo!mance bond in a`orm approv~ed by the CSty Attorney and in an amount dete~mined by ?he City Engineer may b~ posted to guarantee the construc- t;on of the require~l improveme~ts wh~ch may include but not necessarily be ;imited to excavation~ cu~bs, gutters, pavement, drainage facilities or other engineering requirements. (3) Street !ight.ing facil~ties shail be i-:stalled i~ accordance with the offictal street lightir.g plan approved by the Utilities Direttor. (4) Fublir, utility easements necessa.*y to serve the s~bject p'operty and/ or area in which the subiect property is situatea shai'. be dedicated to the City in accordance with the requi-ements of the Utilit'fes Director. Electrical ut:l~ties shall be placed underg~o~nd and dedicated to the City of Anaheim ~n accordance w~th the requirements of the Utilities Directo-. (5) Necessary fire p~otect~on facilities shall be provided for in ac- cordance with the requirements of the Fire Chief. (6) Street tree fees in the amount specified by the City Cou~cil~for any abutting street ar highway shall be paid to the City of .4naheim for the fu,-- nishing and planting of ~equired trees. (7) The Building fnspector shall not grant final release or issue a fir.al certificate of occupancy to a~y building constructed upon any property coverea by this Chapter until the City Engineer has ce-tif?ed to complianc:e with the conditions set forth in (,1) and (2) above, the Utiiities Director has certified to compiiance with the conditior.s set forth in (3) and (4) above, the Fire Chief has cert(fied to compfiance :•:ith the conditions set forth i^ . (5) above, and the Director of P~~blic Works has certified to compliance w?th the conditions set forth in (6) above. SECTION 18.57•070 - CLARlFICAT!ON OF USES If any use is for any reason omitted from the information requirea in the adapted General Plan of Development, or if ambiguity arises conce;ning the classification of a particular use within the meanirty and intent of this ordinance, it shall be the duty of the Planning Cortmission to ascertain all pertinent facts concerning such use and determine if such proposed use•is con- sistent with the intent of the Gene:al Plan of Development adopted by the City. If the Planning Commission finds sucfi proposed use to be consistent wlth the intent of said General Plan, such use shall be incorporated or included therein. If the Planning Commission disapproves said use, the applicant may appeal in writing to the City Council whose decision will be final. - ~.; . . . .
