Thet the proposed use is pcopeciy one for which a Conditional Use Permit is authorized by Code Sectiol 18.64.020(3-j-3) to wit: establish a drive-through restaurant in the M-1 Zone. 2. Thet the pcoposed use will not adversely aEEect.the adjoining land uses and the gcowth end development ut the area In which it is proposed to be located. 3, Thet the size and shape of the site proposed for the use is adequatc to allow the full development of ti;.: pmposed use in a menner not detrimental to the particular erea nur lo the peace, health, sefety, and general welfere of the Citizens of the City of An9heim. 4. That the gcanting of the Conditionel Use Permit under the conditions imposed, if any, will not 6e detrimental to the peace, health, safety, and general welfare of the Citizens of the City oE Anaheim. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commiasion, in connection with an Exemption Declaration Status request, finds and determines that the proposal would have no significant environmental impact and, therefore, recommends to the City Council that no Environmental Impact Statement is neces- sary. Cl-G ' 1' ~ ~ NOW, THEREFORE, BE 1T RESOLVED thet the Aneheim City Plenning Commission does hereby grent subject Petition for Conditionel Use Permit, upon the following conditions which ere hereby found to be a necessery prerequisite to the proposed use oE the subject peoperty in ocder to presecve the sefety end generel aelEeee of the Citizens of the City of Anaheim: I (1) That the sidewalks and driveways shall be installed along State College Boulevard as required by the City ~ngineer and in accord~ace with standard plane and specifications on file in the office of the City Engineer. (2) That the owner(s) of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along State College Boulevurd for street lighting purposes. (9) That the owner(s) of subject property shall pay to the City o£ Anaheim the suw of 15 cents per front foot along State College Boulevard for tree planting purposea. (4) That erash atorage areas ahall be provided in accordance with approved plans on file with rhe office of the Director of Fublic Works. (5) That fire hpdrants shall be installed and charged as required and deteimined to be aecessary by the Chief of the Fire D~partment prior to co oeerlmeshielded fromrviewreandgthe (6) That all air conditioning facilities shail be p p ,~ sound buffered irom adjacent properties, (7) That a parcel map to record the approved division oE aubject property be submiCted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. (8) That subject property shall be served by underground uti'_:.ties. (9) That appropriate water asses4ment fess as determined by the Director of PuL•lic Util~ ties shall be paid to the City of Anaheim prior to the issuance of a building permit. (10) That subject property shall be developed substsntially in accordance with plans and specifications on file with the City.of Anaheim marked Exhibit Nos. 1, 2, 3, 4, and 5.
