PC 73-54'•' ~• RESOLUTION ~ PC73-54 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITIUN,FOR CONDITIONAL USE PERMIT ~~~q BE ~g(~pITED WHEREAS, the City Plenning ~ommission of the City of Anahe'sm did ceceive a verified Petitioa for Con- ditional Use Permit Ecom DOUG BROWNE, 967 AmbridgE Avenue, Anaheim, California 92806, Owner df certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot 3 of Tract 2300~ as shown on a map thereof recorded in Book 68, Pages 35 and 36 of Miscellaneous Maps, in the office of the County Recorder of said Orange County ; and WHEREAS, the CityPlenning Commission did hold a public hearing al the CityHall in the City of Anaheim on March 19, 1973, at 2:00 o'clock P.~7., notice of said public hearing having been duly given a~ cequiced by law and in accocdence with the provisions of the Anaheim Municipel code, Chepter 18.64, to hear and consider evidence for and against said pcoposed conditionel use and to investigate and make findings end recommendations in connection therewith; e~id WHEREAS, seid Commission, after due inspection, investigation, end study mede by itseif end in its'br half, and after due couside:ation of all evidence and reports offered at said hearing, does find and de[ermine the following facts: 1. That the proposed use is pmperly one for which a Conditional Use Permit is authorized by Code : Section 18.40.050(e) ~o ~vit: establish retail sales and repair of musical in~truments ard also for a studio for giving musio lessons in two exis~ing residences, with waivers of: (a) SECTION 18.40.070(2-e-5) - Minimum side setbaok from an "R" Zone. (10 feet required; 7 and 9 feet existing) (b) SECTION 18.40.070(3-a) - Maximum 'bui;lding height wi.thin 150 feet of an "R" Zone. (3 feet high permittod at 7 feet from "R" Zone; 10~ fr~et high ezisting) 2. That Waivers 1-a and 1-b, above mentioned, aro hereby granted so long as the single family resi.dences ara used for the req~xested use, and said •~vai.vers shall teY~- minate if and when the residences are removed and a commercial structure is constructed on tha basis that the buildings were already in existence. 3. That the proposed use as gr~znted v~ill not advarsely affect the adjoining land izse5 and the growth and development of the aree in vihich it is proposed i;o be located. 4. That the size and shape of the site proposed for the use is adoquate to allovr • the full development of the proposed use r~s gr•anted in a manner not detrimentaZ to the particular ares nor t•o the peace, health, saPety, and general welfare of the Citizons of the City of Anaheim. 5. That the granting of the Conditional Uee Permit under the conditions imposed, if any, will not be detrimental to the pesoe, health, safety, and general welfare af the Citizens of the City of Anaheim. 6. That one person appeared in opposition, and a petition signed by 6 persons was received, all in opposition. ENVIRON[vfENTAL IMPACT REPORT FINDING: That the Planning Commission, in connection with an Exemption Declaration Status request, finds and determines that the proposal would have no significant onvironmental impact, and therefore, recommends to the City Council that no Environmental Impact Statement is necessary. -i- .. ,~ ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does hereby grant/subject Petition for Conditional Use Permit, upon the [ollowing conditions which are hereby Eound to be a necessary prerequisite to the proposed use of the subject pcoperty in ordec to pcesecve the seEety end genecal welfare of the Citizens of the City of Aneheim: (1) lhat thi~ conditional use permit is granted subject to the completion of Re- r,lassification No. 72-73-37, now pending. (2) That specific plans for any proposed development or remodeling on the property st~all be submitted to the Planning Commission and City Council for approval prior to the intY•aduction of an ordinanca rezoning the property Yor commercial uses. (3) That prior to final bui].ding and zoning inspec~ions, the petitioner shall pro- vide adequate sound attenuation devices in the structure to eliminate a noise nuisanco Ueing created by the proposed musical activity.
