PC 73-6~ _ RESOLUTION NO. ~ PC 73-6 A RLSOLLITION OF THE ~ITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2467 BE DENIED WH6REAS, the City Planning Commission of the City of Maheim did receive a verifed Petition for Variance from DE WITT R, LEE, ET AL, Post Office Box-3698, Anaheim, California 92803, Owner; ARTHUR HANCOCK, Post' Office Box 369£, Anaheim, California 92803, Agsnt of certain real prop- erty sieuz~ted in the City of Anaheim, County of Orange, State of California, :-escribed as the west 230.00 feet of the south 188,00 feet of the north 254.00 feet of 'che north- west quarter of ~er.tioa 18, Township 4 South, Range 10 west in the Rancho Los Coyotes, ~s per map recorded in Book 51 pege 10 of Miscellaneous Maps, in the office o£ the County Recorder of said county. Except L•hat portion thereof describe3 as Parcel 2 in a deed to the State of Ca~iforniAr recorded Mar~h 12, 1957 in Book 3833 Page 517 of Official Records. A portion of said land is included within the area shown on a map fil~hl in the office of the County Reca:der of said Orange County, in Book 34 page 44 of Record of Surveys in the office of the County Recorder. of said coun.*.y; and WHEREAS, lhe City Planning Commission did hold a public hearing at ihe City H~ill in thc City of Maheim on January 8, 1973, at 2:00 o'clock p.m., notice of said public hearing having been duly given as required by law and in accordance with thc provisions of the M;ilteim Municipal Code, Chapter 18.68, to heaz and consider evide•nce for and against said proposed variance and to investigate and make findings and recommendations in connection thercwith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itsclf and in its behalf, and after due consideration of all evidence an3 reports ofCered at said hearing, does Gnd and determine the following facts: 1. That thc petitioner requests ~ variances. frna~ the Anaheim Muclicipal Code as follows: a. SECTION 18.63.030 - Minimum distance of r, billbo&rd from e sinqle family residence, (75 feet required; approximately 35 feet distance proposed) b, SECTION 18.63.U50(b) - Minimum front setback, (35-foot aetback required; D aetback proposed) 2, That the petitioner proposea to establish a 40-s~uere foot directional billboard on th~ 30-foot Pasement to Lincoln Avenue. 3, That the petitioner~s establishment is adequately signed and to approve off- location signing of the existing use, would establish an undeairable precedent with aimi- 1ar requests for off-si.te signing. 4. That there are no exceptionai or. extraordinary circumstances or conditiona appli- cable to the property fnvolved or to the intended use of the property that do not apply generally to the property or clasa of use in the same vicinity and zone. 5. Thet Che requested variance is not necessary foc the Freservation and enjoyment of a substantial property right poeaeased by other property in the same vicinity and zone, and denied to the property in queution. 6, That the requeated variance will be materially detritinental to the public welfare or injurious to ehe property or improvementa in such vicinity and zane in which the property ~ is loca=ed.
