PC73-71 '~_ A RESOLUTION OF THE C1TY PLANNII~IG COMMISSION OF T'HE C1TY OF ANAHETM RECOMMENDING TO THE CITY COUNCIL OF TtiE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. 72'~3'42 BE APPROVED WHEP.EAS, the City Plenning Commission of the City of Aneheim did receive a verified Petition for Reclassifica- tionfrom GUISEPPE I~OTA.°.U, 202 ~cho Avenue, Anaheim, Ca~ifornia 92801, Owner of certain real property ~ftuated in the City of Anaheim, County of Orsnge, State of California, described as The West 100 feet of the East 448 feet of the North 260 feeC of the Northeast quarter of the Northeast quarter o£ the Northeast quarter of Section 13, in Township 4 South, Range 11 WesL•, San Bernardino Aase and Meridian; EXCEPTING THEREFROM the North 66 feet as granted to the State of California for highway purposes be deed recorded July 13, 1955, in book 3136, page 249, Official Records ; and WHEREAS, the Ciiy Planning Commission did hold a public hearing et the City Hell in the City of Aneheim on April 16, 1973, at 2:00 o'clock P.M. notice of seid publ;c heasing heving been duly given as required by lew and in acco:dence witk the provisions of the Aneheim Municipal Code, Chapter 18.72, to hear and conslder evidence for und ageinst seid pioposed ceclessification end to investigate and meke findings end recommendations in connection thecewith; and WHEREAS, seid Commission, after due inspection, investigation, end s!ndy mnde by itself and in its behelf, and efter due consideraiion of all evidence end report~ o:Eered at seid heacing, does find and detecmine the following fects: 1. Thet the petitioner proposes a reclassificetion of the above described property from the R-A, AGRICULTURAL, Z014E Co [he C-1, GENEP.AL COrQtERCIAL, ZONE. 2. That the proposed reclassification is nor in conformance with the General Plan, but corresponds L•o existing zoning and land uses in Che area. 3. Thet the proposed reclassiEicetion of subject property is necessery and/or desirable for the orderly and pra per development of the community. 4. That the pcoposed reclassificetion of subject pcoperty does properly relete to the zones and ~heir permitted uses locally established in close pcoximity to subject pcoperty and to the zones end their pecmitted uses get;e:~ily estab- lished throughout the community. 5. That Che proposed reclassification of subject property requires the dedication and improvement of abutting streets in accordance with the Circul•'.ion Element of the General Plan, due to Lhe anticipat•ed increase in traffic which wi12 } generated by Che intensifica- tion of land use. R-A "1" • NOW, THEREFORE, BE :CT ~OLVED that the Anaheim City P1~ ing Commission does hereby recommend to the City Council of the City of Anaheim that subject Petition for Reclassifi- cation be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above described property from the R-A, AGRICULTURAL, ZONE and to in- corporate said described property into the C-1, GENERAL COMMERCIAL, ZONE, upon the follow- ing conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in ordet: to preserve the safety and general welfare of the Citizens of the City of Anaheim: ' (1) That ell engineering requirements of ehe City oE Anaheim along Lincoln Avenue, in- cluuing preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalky, :street grading and paving, drainage facilities, or other appurten&nt work shall be complied'ailth as required by the City Engineer and in accordance with standard plans and specificatir~ns ~n file in the office of the City Engineer; and that a bond in an amount and form satisfact:ory to the City of Anaheim shall be posted with the City to guaran- tee the installation of t:he abbve mentioned requirements, (2) That the owner(s) of subject property shall pay to the City of Anaheim the aum of $2.00 per f'ront`foot along Liricoln'Avenue for streeE"lighting'purposes.: ''.` '• ,(3) That.the owner(s) b£•.subject property'shaZl pay'Eo the.City of Anaheim the sum of 15 cents per front foot along Lincoln Avenue for tree plEnting purposes. (4) That trash stor~ege areas shall be provided in accordance with approved plans on file with the office of tLle Director of Public Works. (S) That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. (6) That a six-foot masonry wall ahall be constructed along the east and south property lines. (7) That all air coriditioning facilities shall be properly shielded from view. (8) That subject pr<iperty shall be served by underground utilities. (9) That the final T~arking plan shall be approved by the`Development Services Depart~ ment, and any landscaped iareas in the parking area shall be protected with six-inch high concrete curbs, and concr~ate wheel stops shall be psovided for parking spacea. (10) Thet drainage of subject propert•y shall be disposed of in a manner that is satis- factory to the City Engin~eer. (11) That che owner(,s) shall acquire accesa to the alley located on the west side of subject property. (12) Prior to the introduction of an otdinance rezoning subject proper.ty, Condition Nos. 1, 2, 3, and 11, abo•ve mentioned, shall. be completed. The provisions or rights granted by this resolution shall }~ecome null and void by action of the City Council unless said coii=. ditions are complied with within one year from the date hereof or such further time as the City Council may grant. (13) That Condition :Nos. 4, 6, 7, S, 9, and 10, above mentioned, shall be complied wtth prior to final building and zoning inspections.
