A RESOLUTION OF THE CITY PLANNIfdG COMMISSION OF THE CITY OF ANAHEIM
THAT PETiTJUN FOR VARIANCE N0. 2494 AE GRAN'TED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Vedance
from GUISEPPE NOTARO, 202 Echo Avenue, Anaheim, California 92801, Owner of certain real
property situated in the City of Anaheim, County of Orange, State of California, described
as The West 100 feetof ttie East 448 feet of the North 260 feet of Che Northeast quarter of
the Northeast quarter of the Northeast quarter of Section 13, Yn Townahip 4 South, Range 11
West, San Bernardino Base and Meridian; EXCEPTING THEREFROM the North 66 feet as granted to
the State of California for highway purposes by deed recorded July 13, 1955, in book 313b,
page 249, Official Records

WHEREAS, the City Plannmg Commission did hold a public hearing at the City Hall in the City of Anaheim
on April 16, 1973, at 2:00 o'clock P.M., notice oE seid public hearing heving been duly given as requiced
by law and in eccordance with the provisions oE the Aneheim Municipal Code, Chepter 18.68,to hear and consider
evidence Eor end against seid proposed varience ond to investigate er.d make fiudings and recommendations in connec-
tion therewith; and
WHEREAS, said Commisslon, efter due inspection, investigation, and study mede by itself end in its behelf,
and aEter due consideratlon of all evidence and reports offeced et sald hearing, does Eind and determine the following

1. Thet the petitioner requests e veriance ~rom the Aneheim Municipal Code:
SECTION 18.40.070(3)(a) - Maximum buildinQ heittht within 150 feet of a sinrtle-
family residential zone boundarv. (S feet permitted;
23 feet proposed)
2. That the petitioner proposes conctruction of a tao-story office building, 23 feet
in height,
3. Thet there ere exceptiona] or extraocdinery circumstences or conditions eppliceble to the property invulved
or to the intended nse of the property that do not apply generelly to the property or cless of use in the seme vicinity
and zonc.
4. That the requested variance is necessery for the preservation end enjoyment of e substuntial pcoperty right
possessed by other property in the seme vicinity and zone, and denied to the property in question.
$, That the requested verience will not be materielly detrimentel to the public welfate or injurious to the prop-
erty or impcovements in such vicinity and zone in which the property is located.
6. That waiver of the height ].imitaCibi- adjacent to a reaiilential zone is granted on
the basia that although a residence is bn the R-A parcel to the east, a non-conforming kennel
is operating on the praperty and, in all probability, it will be zoned for cormnercial use aC
some future date.

That the Planning Commission,in connection with an exemption status request, finda and determines
that Che proposal would have no significant environmental impact and, therefore, recownends to

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does hereby granUsubject
Petition for Variance, upon the following conditions which ere hereby found to be a necessary precequisite to the pro-
posed use of the subject pcoperty in arder to pteserve the sefet; end geneeal welfere of the Citizens of the City oE
Anaheim:
(1) That this variance is granted sub3ect to the completior. of Reclassification No,
72-73-42.
(2) That subject property shall be developed substantially in accordance with plana
and specifications on file with the City of Anaheim marked ~xhibit Nos. 1, 2, and 3.
