BAVATI, 2154 Nowell Aveaue~ Rowland Heights, California 91748, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California described as That portion of Lot 1 of Tract No. 58, Peralta Hills Tract' No. 1, as shown on mep recorded in Bo'ok 10; Page 6 of Miscelianeous Maps, in the of- fice of the County Recorder of saxd county, acquired by the State of California by Portion B of Parre2 1 of Final Order of Condemnation, S,C.C. No. 158978, recorded in Boak 9154, Page'945 of Offi:cia3 Records in:said office ; and WHEREAS, the City Plenning Commissior, did hold a public heacing at the City Hall in the City of Aneheim on April 30, 1973, at Q:00 o'clock P.M., notice of said public hearing having been duly given as cequired by law and in accordance with the provisions of the Maheim Municipel code, Chepter 18.64, to hear end consider evidence for and egainst said proposed conditionel use end to investigate and meke findings end recommendetions in connection therewith; end WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its br helE, and aEter due consideretion of all evidcnce end reports offered at said hearing, does find end determine the following fects: 1. That the City of Anaheim, upon annexation of the Peralta Hills area made an agreement to retain said area in its rurai residential atmosphere, and the proposed use would be a non-residential use encroaching into this area. 3. That in order to maintain the integrity of the City of Anaheim and to insure that the good faith of its citizens is retained, the &nnexation agreement made by the City to the residents should be honored. 4. That under City Council Policy No. 207, residents of the Peralta Hills area were assured that the residential amenil•ies of the area would be retained by not re- quiring the standard city curbs and gutters for streets; nowever, with the use pro- posed, on-street parking could be anticipated, which would be extremely hazardous in this area where streets are considerably narrower than standard City streets. 5. That the land uses of the area have not chaaged since the Planning Commiasion previously denied a church use in May, 1972, in the Peralta Hills to warrant favorable consideration of the proposed request. 6. That the size and shape of the site is not adequat~e because of topography and terrain to allow the full development of the proposed use in a mannar not detrimental. to L•he particular area nor Co th~ peace, health, safety, and general welfare of the citizens of the City of Anaheim. That two !2) persons appaared representing 35 persons present in the Council Chamber, all in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission, in connection with an Er.emption Declaration Status re- quest, finds and determines that the proposal would have no significant environmental impact,and, therefore, recormnends to the City Council that no Environmental Impact Statement is necessary. NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does hereby deny subject Petition fox Conditionel Use Pertnit on the besis of the aforementioned findings.
