PC 73-93 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE ~ITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. ~507 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Veriance from RICHARD J. AND BETTY B, FILLMAN, 112 Connie Circle, Anaheim, California 92806, Owners; BRIAN DAJIS, 2736 West Orangethorpe, Fullerton, California 92633, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot 6Q of Tract No. 70fi8 ' ; and WHEREAS, tha City Plenning Commission did hold a public. hearing at the City Hall in the City of Aneheim or May 14, 1473, at 2:00 o'clock P.M., notice oE said public heacing heving been duly given as requiced by lew and in accordance with the provisions of the Anaheim Muaicipal Code, Chepter 18.68,to hear and consider evidence foc and egainst seid proposed variance end to investigete and make findings end recommendations in connec- tion thecewith; and WHEREAS, said Commissinn, after due inspection, investigation, end study mede by itself end in its behelf, and efter due consideration of all evidence end reports offered at snid heering, does find end determine the following fects: ' ~ 1. Thet the petitioner requests a varience from the Anefieim Municipal Code: SECTION 18,26.U50(3) - CoveraKe and Open Space requirements. (35% maxim~ lot coverage allowed; 44.9% coverage proposed) 2. That theee are excepkionel ar extceordinary cicrumstences or conditions applicable to the propeety in~~olved or to the intended use o£ the property that do not apply generelly to the property or class oE use in the same vicinity end zone. 3. That the requested varience is necessary for the pceservation and enjoyment of a substantial pmperty right possessed by other property in the same vecinity and zone, end denied to the pcopedy in question. 4. That the cequested verience wiil not be materially detrimental to the public welfare or injurious to tl:e pmp- erty or impcovements in such vicinity and zone in which tl~e pcoperty is located. ENVIRONMENTAL IMPACT R~PORT FINDING: That the Planning Co~ission, in connection with an Er.emption Declaration Status request, finds and determines that the proposal woul~l have no significant environmental impact and, therefore, recommends to the City Council that no Environmental ImpacE StatemenY is necessary.
