PC 73-94;'_ _ _ ~ . ~ ~ .. - itESOLUTI~N N0. _ P~73-94 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITIOh FOR VARIAN4E N0. 2508 3E DENIED WHEREAS, the City Planning Commission of the City of Anaheim did reccive a verified Petition for Variance f:om DR. FRED M. IZAY, 220 Laguna Road, Fullerton, California 92632, Owner; BUTLER HOUSING CORPORATION, in care of W. Keusder, 1691 Kettering Street, Irvine, California 92705, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hali in the City of Anaheim on May. 14, 1973, at 2:00 o'clock p.m., notice of said public hcaring having been duly ~iven as required by iaw and in accordance with the'provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said proposed variance and to investigate and make findings and cecommendations in connection thecewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itseif and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner requests a variance from the Maheim Municioal •".ode as follows : SECTION 18.26.050(3) - Meximum lot coverage. (35% lot coverage permitted; 35.4% to 39.5% lot coverage proposed for 25 lots) 2. That the petitioner had not proven a hardship would exist if the requested waiver was not granted. 3. That subject.property can and should be developed within the requirements of the site development standards of the RS-5000 Zone. 4. That the Commission in the past had granted only minor deviations from Che RS-5000 Zone coverage requirements in connection *aith requests from individual home owners, however, this deviation from the caverage r.equirement on 48% of the lots in the subdivision, if approved, would be granting the petitioner a privilege not enjoyed by other developers of similar type homes since the adoption of the current site devel- opment standards. 5. That there are no exceptional or exCraordinar,y circumstances or conditions 8ppli- cable to the property involved or to the intended use of the property that do not apply. generally to the property or c~ass of use in the same vicinity and zone. 6. That the requested variance is not necessary for the preservation and enjoyment of a sub3tantial property right possessed by other property in the same vicinity and zone, and denied tn the property in question. 7. That the requested variance will be materially detrimental Co the public welfare or injurious to the property or improvemente in such vici.nity and zone in which the prop- erty is located. ENVIRONMENTAL IMPACT REPORT F:CNDING: That the Planning Comreission finds and determines that Environmental Impact Report No. 18 had been submitted previously and the City Council had adopted it as their Environmental Impact Statement, therefore, the Planning Commission recommends to the Cit'y Council that said s:atement be reaffirmed.
