PC 75-101~ RESOLUTIOtJ N0. PC75-101 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1534 BE GRANTED. WHEREAS, the City ~'lanning Commission of the City of Anahe:~m did receive a veril'icd Petition for Conditional Use Permit from DALE FOWLER, 1430 South Grand Avenue, Santa Ana, California 9Z705 (~+ner); JOHN H. FINNEY, 2950 Miraloma Ave~ue, Anaheim, Califor~nia 92806 (Agent) of certain real pr~perty situated in the City of Anaheim, County of Orange, State of California, described as: Lots 21, 22, 23 and 24 of "Eucalyptus Forest Tract" as shown on a map recorded ir, Book 5 pages 29 and 30 of Miscellaneous Maps, records of said Orange County. EXGEPTING THEREFROM the South 30 feet of the East 100 feet of Lot 23• ALSO EXCEPTING THEREFROM thp southerly 135 feet of Lots 23 and 24; aiid WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the ~ity of Anaheim on May 12, 1~75, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisi::ns of thP Anaheim Municipal Code, Chapter 1a.03, to hear and consider evtdence for and against said proposed conditional use permit and ta investigate and make findings and recomme.ndations in conrtection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and i~ its behalt, and after due consideration of all evidence and reports offered at said hearing, does find and determine the fcllowing facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Code Section 18.61,050.070, to wit: permit an automobile repair facility in an existing industrial comple~:. 2. That the proposed use will not adversely affect the adjoining land u~es and the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full developme~t of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 4, That the granti~g of the Conditional Usc Permit under the canditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5, That no one indicated their presence at said public hearing in opposition and no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of the De~ielopment Services Depsrtment has determined that the proposed activity falls within the definition of Section 3.01, Class l, of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categarically exempt from the requirement to ffle an EIR. NOW, THEFFFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for C~nditional Use Permit, upun the following conditions ~~hich are hereby foun~ to be a ne:cessary prerequisite to the proposed use of the subject property in order to preserve. the safety and general wclfare of the Citizens of the City of Anaheim: l.
