That the peYitioner requests the following waivers from the Anaheim Municipal Code, to permit an existing block wall and lanai in the RS-7200 Zone: (a) SECTION 18.04.043.101 - Maximum wall heiqht. (42 inches permitted; 70 inches existing) (b) SECTION 18.26.066.011 - Minimum number of e~closed parkina spaces. 2 spaces required; 1 s ace existing) 2. That Waiver 1-a, above-mentioned, is hereby granted on the basis that similar walls exist in the subject area. 3. That Waiver 1-b, above-mentioned, is hereby granted on the basis that the remodeling of subject garage, thereby reducing the n~mber of enclosed parking spaces from two to one, apparently occured prior to the current Code requirement that two enclosed parking spaces be provided. 4. That there are• exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply 9enerally to the property or class of use in the same vicinity and zone. 5. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 6, That the requested variance will not be mat•~rially detrimental to the pu:,lic welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 7, That no one indicated their presence at said public hearing in opposition, and no coriespondence was received .in opposition to subject petition. ENVIRONMENTAL IMPA~T REPORT FINDING: That the Director of the Development Services Department has determined that the proposed activity falls .•:;thin the definition of Section 3.01, Class 5, of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, ttierefore, categorically exempt from the requirement to file an EIR. PC75-1o3 ..- ~ ' '' ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are her2by found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheirtr. 1, That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. 2, That plans be submitted to the Building Division and that Building and Electrical permits be obtained. 3, That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Fxhibit No. 1. 4. That Condition Nos. 1, 2, and 3, above-mentioned, shal~~ be completed within sixty (60) days of the date of approval or such further time as the Planning Commission may grant.
