Rose, 703 North Lemon, Anaheim, Ca, 9'L803 (Agent) of certain real property situated in the Cit.y of Anaheim, Coun~y of Orange, StaCe of California, described as: • LOT 15 IN 9LOCK "A" OF TRACT N0. 237> IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, $TATE OF CALIFO"NIA, AS PER MAP 1'HEREOF RECORDED IN BOOK 13 PAGE 24 OF MISCELLANEOUS MAPS, IN THE OfFICE OF THE COUNTY RECORDER OF SAID COUNTY. , EXCEPT THE WEST 49 FEET THEREOF; and WHEREAS, the City Plan~in9 Commicsion did schedule a public hearing at the City~Hall in the City of Anaheim on March 3, 1975, et 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provislons of the Anaheim Municipal Codz, Chapter 18.~3, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and rec~mmendations in connection therewith; said public hearing having been continued to the Planning Commission meeting of May 28, 1975; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts:' 1, That the proposed use is properly one for which a conditional use permit is authorizad by Code Section 18.34.050.080, to wit: permit a board and care facility for the treatment of alcoholics. 2, That the proposed use will not adversely affect the adjoining land uses ' and the growth and development of the area in which it is proposed to be located: 3. That the size ar~d shape of the site proposed for the use is adequate to .alSow the full development of the proposed use in a manner not detrimental'to the•particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim, 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That th~ Planning Commission does hereby determine that the proposed use shall be granted for a period of two years, subject to review and consideration for extension of time, upon wrttter, request by the petitioner. 6~ That the Planning Commission does hereby determine that the proposed use shall be granted subject to a grant being awarded by the Office of Alcoholic Program Manage- ment within the next forty-five (45) days from date hereof, and that the existing structure shall be brought up to the minimum standards of the applicable Building Codes within an additional forty-five (45) day period of time, or ninety (90) days from the . date hereof. . • 7. That one (l) person indicated his presence at said public hearing in opposition, I and two (2) letters were received in opposition to subject petition. ~ EP7VIRONMENTAL IMPACT R~POftT FINDING: That the Directur of the Development Services Department has determined Yh~: the proposed activity falls v~ithin the definieion of Section 3.01, Class 1, of the City of Anaheim Guidelines to the Requirem~nts for an EnvironmenCal ImpacC Report and is, therefore, categorically exempt from the requirement to file an EIR. PC75-109 ~ ~~ . ; ~ ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Anahsim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found tc be a nece.ssary prerequisite to the proposed use of the subject prnperty in order to preserve.the safety and general welfare nf the Citizens of the City of Anaheim: 1.
