EXCEPT SAID LOT 11 THE EASTERLY 70.00 FEE'i TN'eREOF; and WHEREAS, the City Planning Commissiart did scheduie. a pubTtc hearing at thc City Nall in the City of Anaheim on May 28, 1975, a7 1:3~ p.m., notice of said publ': hearing naving been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendatiohs in connection therewith; and ~ WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1, Tha~ the petitioner requests the followin9 waivers from the Anaheim Municipal Code, to expand an existing 12-unit apartment complex to 16 units in the RM- 1200 Zone; ' (a)• SEf,TION 18.34.061.010 - Mintmum buildin site area per dweltin unit, 1200 sq. ft. required; 797 sq. ft, proposed) • (b) SEC710N 18.34.062.032 - Plinimum floor area, 700 s, ft. required; 05 to 2 sq. ft. proposed (c) SECTION 18.34.063.022 - Minimum sideyard setback, (15 and 16 feet . required; 5 feet proposed) (d) SECTION 18.34.063.037. - Minimum recreational leisure area. (~200 sq. ft. required; 1 80 sq. ft, proposed) (e) SECTION 18.34.066.010 - Minimum number and type of parking spaces. (?4 ' spaces required; 6 spaces proposed; and 16 enclosed • spaces required; 4 enclosed spaces proposed) 2. That the above-mentioned waivers are hergby denied on the basis Yhat the proposal would overbuild the property and, therefore, be detrimental to the surrounding properties; and, further, that the proposal would not provide a good living environment for the tenants who would occuply the apartment units. 3, That the granzirtg of the above-mentioned walvers would set an undesirable p;eced~nt fc+r futa~r~ similar reqs~ests in the City of Anaheim. ~-, Thpt there are no excep;ior~al or extraordinary circumstances or conditions applicable to thz property involved or to the intended use of tne property that do_not apply generally tp the property ow clasS of use in the same vicinity and zone. 5. That the requested variance wtll'be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located, 7, That four (4) persons appeared at said public heartng in opposition end said persons also submiCted a petition in opposition to subject variance.
