PC 75-114~ ' ~ RESOLUT104 NO PC75-114 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM TtiAT PETITION FOR VARIANCE N0, 2703 BE GkANTED, WHEREAS, the City Planning Commission of the City of Anahei~ did receive a verified Petition for Variance from VASILE KELEMEN, 700 South Euclid Street, Anaheim, Ca. 92802 (Owner) of certair~ rea; property situated in the City o.f Anaheim, County of Orange, State of Califor~ia, described as: • Lat 90 of Tract No. 2381, in the City of Ar~aheim, County of Orange, State of California, as show~ on a map recorded in book 69, pages 15, 16 and l7 of Mtscellaneous Maps in the office of the county recorder of said county; and WHEREAS, the City Planning Commission did schedule a public hearing at the City Hall in the City of Anaheim on May 28, 1975, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by-itself and in its behalf, and after due consideratio~ of all evidence and reports offered at said hearing, does find and determine the following facts: 1, That the petitioner requests the following waiver from the Anaheim Municipal Code, to ~siablish a printing shop: SECTION 18.41.020 - Permitted uses.(Printing shop not permitted) 2, That the above-mentioned waiver is hereby granted on the basis that the petitioner stipuiated that most of the printing will be done off-premises, except for small quantities of offset printing (such as letterheads and envelopes) which will be done on-site `or faster delivery.to the customers, and that the printing press is approxima.tely the size of a photo-copy machine and generates noise not. much stronger than a mimeograph duplicator. • 3, 7hat the petitioner stipulated to submitting plans for the signing for the proposed use, said signing to be in conformance with the "CO" Zone standardg on the basis that Planning Commission determined the subJect strueture has been sufficiently modified to be classified as a commercial building rather than a residertial building; and that said plans shall be reviewed and approved by the Development Services Depart- ment, , 4, That the petitioner stipulated to terminating Variance No. 2472, as a conditior of approval uf Variance No. 2703. ' 5, That there are exceptional or ex+_raordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vtcinity and zone. 6. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other p~operty in the same vicinity snd zone, and denied to the property in question. • 7, That the requested variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 8. That no one indicated their presence at said public hearing in oppo~ition, and no correspondence was received in opposiCion to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: . That the Director af the Development Services Department has determined that the proposed activity falls within the definition of Section 3.01, Class 1 of [he City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categnric•,lly Px~mpt from the requirrrr~nt tn file an EIR. NOW, THf.REFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the follawing cond3tions which are _:hereby found to be a necessary prerequisite to the proposed use of the subject property in order to Qreserve the safety and general weifare of the Citizens of the City of Anaheim: ' 1, That subject proper~y shall be develaped substantiaily in accordance with plans and specifica•tions on file with the City of Anaheim marked Exhibit Nos. 1 and 2; provided, however, that plans sha11 be submitted for the signing for the proposed use, said plans to be in conformance with the "CO" Zone standards and subject to the approval of the Development Services Department, as stipulated to by the petitioner. 2. That this variance is granted subject to the petitioner submitting a written request to terminate Variance PJo. 2472 on the subject pro~erty. 3.
