PC 75-116~ ~ RESOLUTION N0. PC75-116 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARlANCE N0. 2697 BE GRANTED, IN PART. WHEKEAS, the City Planning Commission of the City of Anaheim di~i receive a verified Petition for Variance from K& B CENTER, 725 West Anaheim Street, Long Beach, Ca. 90A13 (Owner); GOOD LUCK MARKET, 1241 South Knott Street, Anaheim, Ca. 92804 (Agent) of certain real property situated in the City of Anaheim, County of Orange, S.tate of California, described as; PARCEL 2: The northeast quarter of the southeast quarter of the northeast quarter and the southPast quarter of the northeast quartar of the northeast quarter of Section 22, Township 4 south, Range 11 west, S.B.B. ~ M. Also a portion of the northeast quarter uf the northeast quarter of the northeast quarter of Section 22, Township 4 south, Range 11 west, S.B.B. ~ M., described as follows: Beginning at the southeast corner of the northeast querter of the northeast quarter of the northeast quarter of said Section 22; running thence west 462 feet; thence north to the north line of said Section 22; thence east along said north line to the southwesterly line of the right of way of the Los Angeles Inter-Urban Raila~: , thence southeasterly along said south- westerly line of said right of way to the point of intersection of the same with the east line of said Section 22; thence sauth to the point of beginning, SUBJECT ALSO to reservations, rights of way and easements of record; and WHEREAS, the City Planning Commission did schedule a public hearing at the City Nall in the City of Anaheim on 11ay 12, 1975, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accorda~ice with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; said public hearing having heen continued to the Planning Commis- sion meettng of June 9, 1975; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: l. That the petitioner requests the following waivers from the Anaheim Municipal Code to permit 3 free-standing signs: a, SECTION 18.05.093.010 - Maximum aaureaate sien area. b. SECTION 18.05.093.021 - Maximum number of sigrs. (2 permitted; ~ proposed) c. SECTION 18.05.093.0231 - Minimum distance between si ns. ( 03 U ft. required; 75 feet and 120 feet proposed d. SECTION 18.05.093.0252 - Minimum ground clear, ance of siqns. 2. That Waivers 1-a and 1-d, above-mentioned, were eliminated by the resubmittal of plans and are, therefore, withdrawn by the petitioner. 3, That Waivers 1-b and 1-c, above-mentioned, are hereby granted on the basis that the petitioner de~o~strated that a hardship wuuld be ereated if said waivers were not granted, since a portion of the property frontage is immediatiely adjacent to a railroad right-of-way, making it difficult to adequately identify a portion of the shopping center; and the two signs fronting on Knott Avenue are existin9. 4. That there are exceptional or extraordinary circumstances or conditions appli- cable to the property invoived or to the intended use, as granted, of the property that do not apply generally to the property or class of use in the same vicinity and zone. 5. That the requested variance, as granted, is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. • 6. That the requested variance, as granted, will not be materially detrimental to the public welfzre or injurious to the property or improvements in such vicinity and zone in which the property is located, RESOLUTION N0. PC75-116 . . . ~ ~ 7. That no one indicated their presence at said public hearing in opposition, and no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of the Development Services Department has determined that the pruposed activity falls witFiin the definition of Section 3.01, Class 11, ot the City of Anaheim Guidelines to the Requirements for an Environmental ~mpact Report and is, therefore, categorically exempt from the requirement to file an EIR. NOW; THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant, in part, subject Petition for Variance, upon the following conditions which are hereby fou~d to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That street lighti~g facilities along Knott Street shall be installed as required by Lhe Director of Public Utilities, and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall b~e posted with the City to guarantee the installation of the above-mentioned requirements. 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60C per front foot along Knott Street for tree plantin9 purposes. 3, That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2 (Revisions No. 1). 4. That Condition Nos. 1, 2, and 3, above-men~ioned, shall be complied with prior to the =ommencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or withir~ a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant.
