PC75-122 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1542 BE GRANTED, WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permit from WILLIAM C. STOOKEY, 125 South Claudina Street, Anaheim, Ca, 92805 ~~Wner); PACIFIC OUTDOOR ADVERTISING, ATTN: JAY KINGRY, 1740 Narva Street, Los Angeles, Ca. 90031 (Agent) of certain real property situated in the City of Anaheim, Courity c~ Oran,e, State of California, described as: Lots 26 to 30 inclusive, Block A, of the Center Tract, as per map recorded in book 14, page 13 of Miscellaneous Records of Los Angeles Cour.ty, California; and WHEREAS, the Lity Planning Commission did schedule a Fublic hearing at the City Hall in the City of Anaheim on June 9, 1975, at 1:30 p.m., notice of said public hearing having b~en duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, a~d after due consideratior. of all evidence and repor:s offered at said hearing, does find and determine the following facts: l. That the proposed use is properly one for which a conditional use permit is authorized by Code Section 18.45.~50.090, to wit; permit the continued use of two (2) existing billboards, with watver of: SECTiON 18.U5.111.021 - Permitted location. (Billboards not permitted in Central City Area) 2. That the Planning Commissio~ hereby determines that approval of the subject conditional use permit shall be made subject Lo the conditions of approval of Conditional Use Permit No. 1480 which was granted by the Lity Council on July 8, 1974, approving the billboards at the subject location for one (1) year. 3, That the petitioner reaffirmed the previous stipulation that, in the event the Community Redevelopment Agency acquires the subject property for redevelopment, prior to expiration of this conditional use permit, all rights to severance damages for removal of the billboards are hereby waived, and that said stipulation will be submitted in writing by the owner(s) of the billboards, prior to City Council review of the proposal, 4, That. the proposed use, as granted, will not adversely affect the adjoining land uses ancl the growth and development of the area in which it is proposed to be located. 5. Thal• the size and shape of the site proposed for tha use, as granted, is adequate to ~llow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, an~l general welfare of the Citizens of 2he CiCy of Anaheim. 6. That the granting of the Conditianal Use Permit under the conditions imposed, if any, will not be detrimental to Che peace, health, safety, and ge~eral welfare of the Citizens of the City of A~aheim, 7. That no one indicated their presence at said public hearing in opposition, and no correspondence was received in opposition to subject petition. ENVIRONI4ENTAL IMPACT REPORT FINDING: That the Oirector of the Development Services Department has determined that the proposed activity falls within the definition of Section 3•0~. Class 1, of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categoricaliy exempt from the requirement to file an EIR. RESOLUTION N0. PC75'~22 ~ ~ NOW, THEREFOFE, BE IT RESOLVEU that the Anaheim Lity Planning Ccmmission does hereby grant subject Petition for Conditional Use Permit, upon the fullo~ring conditions which are hereby Found to be a:7ecessary prerequisite to the proposed use of the subject property in order to preserve the safety and ge~eral welfare of the Citizens o~ the City of Anaheim: 1. That the subject property shall be developed substantiaily in accordance with plans and specifications on file with the City of Anaheim marked Exhibit tvo. 1. 2. That this conditional use permit is granted for a period of one (1) year, tc expire on June 9, 1976, at which time the biliboards shall be removPd from the subje~t property. 3. That, in the event the Community Redevelopment Agency acauires the subject property for redevelopment, prior to expiration of this conditional use permit, all rights to severance damages for removal of the billboards are hereby waived, as stipulated to by the petitioner; and further, the forego+ng stipulation shall be submitted in writing by the owner(s) of the billboards prior to City Council review of the proposal. 4. That the applicant is hereby granted permission to illuminate said bil)boa•ds for the one (1) year period that said billboards are permitted to exist, THE FJREGOING RESOLUTION is signed and approved by me this 9th day of June, 1~~75.
