PC75-130 A RESCLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. 74-75-37 BE APPROVED. WHEREAS. the City Planning Commission of the City of Anaheim did receive a verified Petition for Reclassification from KATHERINE A. CYPRIEN, 121 North Milton Street, Anaheim, California 92806 (Owner); PAUL BRUCKNER, JR., 17341 Irvine Boulevard, Suite 111, Tustin, California 92680 (Agent) of certain real property described as: . That portion of the South half of the North half of the Southwest quarter of the Northeast quarter of Section 12, Tc•~nship 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, county of Orange, state of California, as said Section is shown on a map recorded in book 51 page i0 of Miscellaneous Maps, in the office of the county recorder' of said county, descirbed as follows: Beginning at the Southwest corner of said South half; thence South 89~ 34' 32" East, along the Southerly line of said North half, a distance of 257.~0 feet; thence North 0° 41' 30" East a distance of 167.80 feet; thence North 89° 18' 3p" West a distance of 100.00 feet; thence North 0° 41' 30" East a distance of 72 feet; thence North 89° 18' 30" West a distance of 157•00 feet to a point on the Westerly line of said Northeast quarter distant thereon 241.00 feet from said Southwest corner of said South half; thence South 0° 41' 30" West, along said Westerly line, a distance of 241.00 feet to the point of beginning; and WHEREAS, the City Planning Commis~ion did hold a public hearing at the City Hall in the City of Anaheim on June 23, 1975, at 1:30 p.m., notice of said public hearing havim3 been duly given as required by law a~d in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and i~ its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following Facts: 1. That the petitioner proposes reclassification of the above-described property f~om the RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) ZONE to the RS-7200 (RESIDENiiAL, SINGLE-FAMILY) ZONE. 2.. That the Anaheim Generai Plan designates subject property for low-density, residential uses. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted usss locally established in close proximity to subject property and to the zanes and their permitted uses generally established throughout the community. 5. That the Planning Commission recommends to the City Council that City Council Policy No. 538 requiring a 40-foot minimum front setback be waived to permit 25-foot front setbacks for those lots proposed to front-on Sunkist Street, on the bases that the 25-foot front setbacks would allow for larger rear yards which are more conducive to a good living environment, and that only the garages and not the habitable rooms of the residences are within said 40-foot setback. 6. That no one indicated [heir pr~sence at said public hearing in opposition, and no correspondence was received in opposition to subject petition. • ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission recommends to the City Council that the subject project be exempt from the requirement to prepare an environmental impact report, pursuant to the provisions of the California Environmental Quality Act. RESOLUTION N0. PC75-13~ . - - ~ . ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend to the City Council of the City of Anaheim that subject Pe*_ition for Reclassification be approved and, by so doing, that Title 18-Zoning of the A.naheim Municipal Code be amended to exclude the above-d~scribed property from the RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) ZONE and to incorporate said described property into the RS-7200 (RESIDENTIAL, SINGLE-FAMILY) ZONE upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Aneheim: 1. That street lighting facilities along Sunkist Street, Cyprien Way and Milton Street shall be installed as required by the Director of Public Utilities, and fn accordance with seandard plans•and specifications on file in the Office of the D(rector of Public Utilities and that a bond in an amount and form satisfactory to the ~ity of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 2. That the owner(s) of subject property ~hall pay to the City of Anaheim the sum of 60~ per front foot along Sunkist S:reet and Milton Street for tree planting purposes. • 3• That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of struc- tural framing. 4. That subject property shall be served by underground utilities. 5. That drainage of svbject property shall '_+A disposed of i~ a manner satis- factory to the City Engineer. 6. In the event that subject property is to be ii~vided ~'•:r the purpose of sale, lease, or financing, a parcel map to record the app:o~~~d division of subject property shall be submitted to and approved by the City of Anaiieim an~ ihen be recorded in the Office of the Orange County Recorder. 7. That the owner(s) of subject property shall pay to the City af Anaheim the appropriate park and recreation in-lieu fees, as determined to be appropriate by the City Counci~, said fees to be paid at the time the building permit is issued. 8. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building perir.it. 9. That the building setbacks shall have a minimum d~oth of forty (40) feet adjacent to Sunkist Street; per City Council Policy No. 53~, unless the City Council grants relief from said policy xind permits 25-foot setbacks for those lots proposed to front-on Sunkist Street. 10. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1 and 2, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become nul' and void by action of the City Council unless said conditions are complied with .~ithin one year from the date here- of, or such further time as the City Council may qrant. 11. That Condition Nos. 4, 5, 6 and 9, above-mentioned, shall be complied with prior to final building and zoning inspections. 1975.
