PC75-13'L A RESOLUTION OF THE GITY PLANNING COMMISSION OF THE CITY OF ANAHEIM kECOMMENDING TO THE CITY COUNCIL OF THE ClTY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. 74-75-38 BE APPROVED. WHEREAS, the•City Planning Commission of the City of Anaheim did receive a verified Petition for Reclassification fromWiLLIAM AND VIRGINIA KUPFER, 220 Ogle Street, Costa Mesa, California 92627 (Owners); LARRY JOHNSON, 528 West 19th Street, Costa Mesa, California 92627 (Agent) of certain real property situated in the Ci•ty of Anaheim, County of Orange, State of California described as~ The North 100 feet of the East half of tha East half of the Southeast quarter of the Southeast quarter and the Ea.t 8 feet of the North 100 feet of the West half of the East half of the Southeast quarter of the Southeast quarter of Section 14 in Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, Page 7, et seq., Miscellaneous Maps, records of said brange County. EXCEPTING THEREFROM the East 40 feet of the North 97 feet of the East half of the East half of the Southeast quarter of the Southeast quarter of Section 14, as conveyed to the State of California, by deed recorded March 5, 1951, in E3ook 2153, Page 250, Official Records; and WHEREAS, the City Planning Commsision did hold a public hearing at the City i'atE in the City of Anaheim on June 23, 1975, at i:30 p.m., notice of said public h~ari~ig having been duly given as required by law and in accordance witF ~the p;~visions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings aRd recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by its.lf and in its behalf, and after due consideration of all evidence and reports offered at said hzaring, does find and determine the following facts: 1. That the petitioner proposes reclassification of the above-described property from the RS-A-43,000 (RESiDENTIAL/AGRICULTURAL) ZONE to the CL (COMMERCIAI., LIMITED) ZONE. 2. That the Anaheim Ge~eral Plan designates subject property ~or general commercial uses. 3. That the proposed reclassification of subJect properCy is necessary and/or desirable for the orderly and proper development of the commanity. 4. That the proposed reclassification of subJect property does properly relate to the zones an~ their permitted uses locall;~ c~stabiished in ciose proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5. That no one indicated their presence at said public hearing in opposition, and r.~ correspondence was received irs opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission recommends to the City Council that the subject proJect be exempt from the requirement to prepare an Environmental Impact Repori, pursuant ta the provisions of the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does her~by recommend to the City Council of the City of Anaheim that subject Petition for Reclassification be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the aoove-described property from~the RS-A-43,000 {RESIDENTIAL/AGRICULTUftAL) ZUNE and to incorporate said described property i~to thP CL (COMMERCIAL, LIMITED) ZONE vpon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to prescrve the safety ancl general welfare of the Ci[izens of the City of Anaheim: RESOLUTION N0. PC75-13z ~ ~ ~ 1. That street lighting facilities along Beach Boulevard shall be installed as required by the Direc~or of Public Utilities and in accordance with standard plans and specifications on file in the office of the Direetor of Public Utilities and that a bond in an amount and form satisfactory to the City of Anaheim shail be posted with the City to guarantee the above-mentioi~ed requirements. 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60C per front foot along Beach Buu;evard for tree ~lanting purposes. 3~ In the event that subject property is to be divided for the purpose of sale, lease, or financing, a parcel map to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recordar. ~. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be instaiic~ and charged as required and deter- mined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That all air-conditioning facilities shall be properly shielded from view, ard the sound buffered from adJacent properties. 7. Tiat subject property shall be served by underground utilities. 8. That sidewalks shall be installed along Beach Boulevard as required by the City Engineer and in accordance with standard plans and specifications on file in tha office of the City Engineer. 9. That drainage of subJect property shall be disposed uf In a manner satis- factory to the City Engineer. 10. That appropriate water assessment fees, as determi~ed by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the tssuance of a building permit., 11. That a 6-foot masonry wali shali be co~structed along the west property line. 12. Prior to the introduction of an ordinance rezoning subJect property, Condition Nos. 1, 2 and 3, above-menr.ioned, shall be completed. The provisions or rights ~ranted by this resolution sfiall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereofi, or such further time as the City Council may grant. 13. That Condition Nos. 4, 6, 7, 8, 9 and Il, above-mentioned, shall be complied with prior to final building and zoning inspections.
