That the above-mentloned waiver is hereby ~ranted on the basis tliat the proposal is to expand an existing building and a liardship woulcl be created if sail waiver were not granted. 3. That there are excepti~r.al or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally Co the property or class of use in the same vicinity and zone. 4. That the requested variance is necessary for the preservation and enjoyr.ient of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 5. That the requested variance will not be naterially detrimental to the pllhlic welfare or injurious to the property or improvements in such viciniCy and zone in which the property is located. 6. That no one indicated their presence at said public hearin~ in opposition, and no correspondence was received in opposition to sub~ect petition. ~NVIRONDfENTAL IMPACT REPORT FINDING: That the Director of the Development Services Department has determined that the proposed activity falls within the definition of Section 3.01, Class 3, o£ tl~e City of Anaheim Guidelines to the Requirements for an Envir.onmental Impact Report and,is, ther.efore, categarically exempt from the requirement to file an EIR.
