That the above-mentioned wai~er is hereby granted on the basi.~ that the subject proper.ty is located on a cul-de-sac and is irr.egularly-shaped; and that equal usable open space is available elsewhere in the rear and side yards of the subject property. 3. That there are exceptional or extraordinary c3rcumstances or conditions appli- cable to thf, property involved or to the intended use of the property that• do not apply generally to the property or c].ass of use in tne same vicinity and zone. 4. That the requested variance is necessary for the preservation and enjoyment of a substantial property righC possessed by other propertq in the same vicinity and zone, and denied to the property in question. • 5.
