PC75-159 ~ A RESOLUTION OF THE ANAH~IM CITY PLANNING COAtMISSION RECOt+C~NDING~TOPT~D CITY COUNCIL OF THE CITY OF ANAHEIM TIIAT RESOI.UTION N0. 74R-235, IN CONNECTION WITH R~CLASSIFICATION i~0. 73-74-36, IIE AMENllED TO DSLF.TE CONDITION N0. 11 PERTAINING TO A PIsRPETUA7. MAINTENANCE AGR~EMF.NT. WH~REAS, on March 19, 1974, the City Council of the City of Anaheim approved Reclassification No. 73-74-36 in Resolution No. 7kR-116, to establish YC zoning for a project known as Anaheim Shores Planned Community on property consisting of approximately 137 acres located northwesterly af La Palma Avenue and Euclid Street, said approval be:ng sub~ect to certain conditions; and 4niEREAS, on May 14, 1974~ the City Council held a rehearing on Rer,2assi- fication No. 73-74-36 and confirmed its earlier acti?n ofsaidraviroval1being~sub~ect cation No. 73-74-36, by adopting Resolution No. 74R--35, PP to certain co~ditions; and j+IHLREAS, Condition No. 11 of City Council Resolution No. 74R-235 states: "That a perpetual maintenance agreement, acceptable to the Cishalltbe filed andce, for the maintenance of the Romneya Drive median landscaping, recorded"; and WHEREAS, the Director of the Public Works Department has requeated deletion of the af~rementioued Condition No. 11 on the basis that Romneya Drive is teing developed as a four--!.ane, secondary-type arterial street, and the City~~ current policy is ta m,^.i.ni:a.'fa a11 arterial streets and highways; and y7HERE,'~S, tl+~~ Anaiieir •`:ity Planning Commission did hold a public hearing at the City Hall in the ~ity ;+f Anaheim on July 21, 1975, at 1:3Q p.m., notice of said public hearing havin5 been r1L:1~~ given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and, consider evidence for and against said proposal and to investigate and make findings and recommendations in connection therewith; and WFiEREAS, said Commisaion, after due inspection, investigation, and sL•udy made by itself and in its behalf.DOES H~FiEBYdFI11D thatesaid Condition Noaelleisnno reports offered at said hearing, longer necessary. NOW, THEREFORE, IlE IT. RESOL~ED that the Anaheim City Planning Commission does hereby recommend to the City CounciY of the City of Anaheim that Condition No. 11 of City Council Resolution No. 74R-235 be deleted, based on the foregoing findings.
