WFI~RFAS, the C9,ty Planning Commission of the City of Anaheim did receive a veri~led Petition fpr Conditional Use Permit from RONALT, S, rNCIC~NTHALER~ 19`l McAnlay Place, Laguna Beach, California 92651 (Owner); ORVILLr II~SERSON, .7R., 22362 Savona Street, Y.aguna Iii.lls, Ca3.i£ornia 92653 (Agent) of certain real property described as: T(tn_ Svuthtatsterly 195.00 feeC of the Northeasterly 660.00 feet of the Southerly :75.~1J feec o£ Lot 2 in block K of the Kraemer Tract, in the City of Anaheim, County n~ ~rang~e, State of California, as per map recorded in book 17., pages A7 and fl8, Mi.~cellaneous Records, in the office of, the County Recorder of Los Angeles County, i:~alifornia. WHEREAS, the City Planning Commission did hold a Qublic hearing at the City Hall in the City of Anaheim on July 21, 1975~ at 1:30 p.m., notice of said public hearing having been duly given aa required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and reco~endations in connection therewith; and WHEREAS~ said Commission, after due inspection, investigation and study made by itself and in tts behalf, and after due coneideration of alY evidence and reports offered at aaiu hearing, does find and determine the following facts: 1. That the proposed use is properly or.e for which a conditional use parmit is authorized by Code Section 18.61.050.070. to wit: permit an automobile repair facility in a vacated aervice station. with wa3.ver of: SECTION 18.61.063.011 - Minimum buildins Setback. (50 Eeet required; 8 feet and 11 feet exiating) 2. That the petitioner stipulated to removing the exieting c~aopies and punp islands and, therefore, the above-mentioned waiver is withdxawn. 3. That the petitioner aCipulated that the sub3ect property will n,ot become a storage place for used automobiles; and, further, that the vacant surrounding property will not be used for parking for the sub~ect use. 4. That the petiCioner stipulated to relocattng the existing trush storage area to allow adequate access for traeh trucks, said area to be in accordance with approved plans on file with the office of the Director of Fublic Works. 5. That the propoaed use, as granted, will not adversely affect the ad~oining land uses and the growth and development of t;~e area in ~~hich it is proposed to be located. 6. That the size and shape of the site proposed for the use, as granted, is adequate to allow the fuxl development of the proposed use in a msnner not detrimental to the partic=clar area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 7. That Che granting of the Conditional Use Permit trnder the conditions imposed, will not be detrimental to the peace~ health, safety, and genera'1 welfare of Che Citizens of the City of Anahefm. 8. ThaC one (1) person indicated their presence at said public iiearing in opposition; and no correspondence was received in opposition to aub~ect petition. ENVIRONMEI~TAL IMPACT REPORT FTNDII7G: That the Dfrector of the Development Services Department has determined that the proposed activity falls within the definition of Sectioa 3.01, Clasa 1', of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. RESOLUTION N0. PC75-161 ~ ~ ~ ~ ~ NOW, THER~EORE, BE IT RESOLVED that the Anaheim City Planaing Co~ission does hereby grant, in part, subject Petition for Conditional Ase Permit, upon the fo.ilow- ing conditiona which are hereby found to be a necessary prerequisite to the proposecl use of the sub~ect propeTty in order to preserve the safety and general weifare of the Citizens o£ the ~ity of Anaheim: 1. That trash storage areas shall be provided in accordance w±th Rgpraved plans on file~with the office of the Director of Public Works, as stipulated to by the petitioner. 2. That the mosC southerly driveway on Miller Street and the most westerly driveway on Miraloma Avenue s~~all be removed and replaced with standard curb~ gutter and aidewalk, and that the required ML Zone landscaped area ahall be~ extended across the removed driveways. 3. That the underground gasoline tanks shall be removed prior to any new constructlon. 4. Plans ahall be submitted to the Building Diviaion showing compliance with the minimum ~tandards of the City of Anaheim, including the Uniform Bui.ldiag, Plumbing, Electrical, Hausir.g. Mechanical and Fire Codes as adopted by the City of Anaheim. The appsopriate pex'mits ahall be abtained for any necessary work. 5. That subject property sha11 be developed substantially in accordance with plana and specifications un file with the City of Anaheim marked Exhibit No. 1; provided, however~ that ths exieting canopies and pump islands shall be removed. 6. That Condition No, 4, above-mentioned~ shall be complied with prior to the commencement of the activity authorized under this resolutiony or prior to the time chat the building permit is issued~ or within a period of one year irom date hereof, whichever occurs first, or auch furtY~er tim~ as the Planning Cosmnission and/or City Council may gtant. 7. That Condition Nos. 1, 2 and 5, above-mentioned, shall be complied with prior to sia$1 building and zoning inspections. 8. That the sub~ect property shall not be utilized for the storaga of used automobiles and, futther, that the vacant surrounding p=operty sha11 not be utilized for parking fos the aubject use, as stipulated to by the petitioner.
