WIi~REAS, the CYty Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permit from CITY OF FULLERTOI~, Attn: Mr. Edmund Grens, Director of Finance, 303 West Commomaealth, Fullerton, California 92632 ((Twner); ROYALE GUEST HOME OF ANAHEIM. 15233 Ventura Boulevard, Suite 316, Sherman Oaks, California 91403 (Agent) of certain real property described as: PARCEY.S 3 AND 4, IN THE CITY OF ANAHEIM, COUNTX OF ORAPIG~* STAT~ OF CALIFOR*1IA, AS SHOWt1 ON A PARCEL MAP FILED IN BOCK 52 PAGE 41 OF PARCEL MAPS IN THE OFFIC£ OF TAE COUNTY RECORDER OF SAID COUNTY; AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City oi Anaheim on July 21, 1975, at 1:30 p.m., notice of said pubiic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said pxopo~ed conditional use and to investigate and make findings and recoffie~ndationta in connection therewith; and ~dHEREAS, sa:3.d Cummission, after due inspection, investigation and study made by itaelf and in its'behalf~ and after due consideratian of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the propoaed use is properly one for which a conditional use permit is authorized by Code Section 18.44.050.170, to wit: permit a guest home. with waivere of: a. S~C:ION 18.44.062.011 - Maximum building height. 20 feet per.mitted; 27 feet proposed) b, SFCTION 18.44.068 - Required block wall. (6 foot masonry wall_reqcired; none proposed) 2. That Waiver 1-a, above-mentioned, is hereby granted on the baais that although the abutting property to the north is zoned residenti.ally, said property is currently developed with a water atorage reservoir and has been .pproved for development in the "CL" Co~ercial. L~mited Zone. • 3. That Waiver 1-b, above-mentioned, is hereby gra~,nted on the basis that the petitioner stipulated Co providing landscaping and an open, decorative-type wall along the north property line, and r.?;at the petitioner sliall submit plane for said wall and landscaping to the UevelopmenC Services Departme:nt for approval. 4. That the pro~~osed use will not adveraeZy a£fect t'r,e ad~oining land uses and the growth and development of the area in which it is proposed to be located. 5. That the size and ahape of the site propoaed for the use is adequate to allow the full development of the proposed uae in a manner not detrimental to the particular area nor to the peace, health, saiety. and general welfare of the Citizens of the City of Anaheim. 6. That the granting of the Conditional Uae Permit under the conditions imposed, if any, will not be detrimental to the peace, health, eafety~ and general welfare of the Citizens of the City of Anaheim. 7, That no one indicated their preaence at said public hearing in opposition; aad no correspondence was received in opposition to aub~ect pet:.tion. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commiasion recovm~ends to the City Council that the sub~ect pr.oje~t be exempt from the requirement to prepare an environ~ental impact report~ pursuant to the provisiona of the California Environmental Quality Act. RESULUTION N0. PC75-162 ~ NOSd, THERLFORE, BE ~ RF.SOLVED that the Anaheim City~.anning Commission does hereby ~rant subject Petition for Conditional Use Permit, upon the fallowing conditiono which are hereby found to be a necessary prerequisite to the proposed use of the sub~ect property in order to,preserve the safety and genera.l welfare of the Citizens of the City of Anaheim: 1. That sidewalks sh~ll be installed alon~ La Palma Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 2. Ttiat trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of' Public Cdorks. 3. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department priar to commencemen*. of structural framing. 4. That gubject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engine~r. 5. In the event that subject property is to be divided for the purpose of sale, lease~ or financing, a. parcel map to record the approved division of subJect property shall be submitted to and approved by the Citq of Anaheim and then be recorded in the office of the Orange County Recorder. 7. That subject property shall be developed subatantially in accordance toith plane and specifications on file with the City of Anaheim marked Exhibit Nos. 1~ 2, and 3; provided howe•rpr, that landacaping and six (6) foot high~ open decorative-type wall shall be installed along the north property line~ and the petitioner shall submit plans for said wall and landscaping to the Development Services Department far approva7.. 8. That Conditicin No. 6, above-mentioned~ shall be complied with prior to the co~nencement of the aqtivi'.y authorized under this resolution, or prior to the time that Che building pemit is iesued, or with a period o~ one year from date hereof, whichever occura firat~ or auch further time as the Planning Commission and/or City Council may grant. 9. That Condition Nos. 1, 2. 4, 5 and 7. above-mentioned, shall be complied with prior to £inal building and xaning inspections.
