A RESOLUTION OF THE ANAHEIM CITY PLAIvTNING COt~L~tISSION FINDING AND
DETERMINING THAT THE PROPOSED PROPERTY EXCHANGE BEThTEEN TtIE
ORANGE COUNTY FLOOD CONTROL DISTRICT AI~ AN ADJACENT PROP~RT.Y
OWN~R, IS IN CONFORMANCE WITH THE CITY'S ADOPTED G~t1fiRAL PLAN.
WHEREAS, the Orange County Flood Control District propose~ to exchange
with an ad3acent pr.operty owner certain land parcels in the vir.inity o£ the
District's Carbon Creek Diversion Channel, south of the Riverside Freeway in the City
of Anaheim; and
WfiEREAS, the Orange County Flood Control Distri.ct also proposes to convey
to said property owner a sewer easement across the Carbon Creek Diversion Channel in
the vicinity of Jackson Avenue; and
WIIEREAS~ the Governmeat Code of the State of California, Section 654~2,
provides in part that a local agency such as the flood control district shall not
acquire real property nor dispose of any real prop_rty, nor construct a public
building or structure in any county or city, until the location, puspose and extent
of such activity has been reporced upon as to conformity with the adopted general
plan applicable thereto; and
WI~REAS, the proposed exchange oi real property rights and conveyance of
sewer easement has been reviewed by the Anahei~a City Plannin~ Commission in
accordance with Section 65402 of the Cali£'ornia Government Code.
NOW, THEREFOP.E, BE IT RESOLVED, that the Anaheim City Planning Cos,cnission
does hereby find and determine that the proposed exchange of real property rights and
conveyance of sewer easement is in conformance with the City of Anaheim's adopted
General Plau.
