71R-171 RESOLUTIO~N NO. 71R-1ll- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEI~l FINDING Al~D DETERMINING THAT TITLE 18 OF THE ANAHEI1,,1 MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZOlJES SHOULD BE CHMJGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. _ 10=ll=il._~. 1 _ ._. _ __...... .. _ to consider an amendment to Title 18 of the Anahe1m Mun1cipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 5th day of --A1lXti...- ._..,' 19 -Lt.. .... as the time, and the City Council Chambers' l.n the City HaIr of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Couficil does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. Parcel A: That portion of the northwest quarter of the southwest quarter of the southwest quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at the northeast corner of lot 162 of Tract No. 2228, as per map recorded in Book 69, page 34 to 37 inclusive of said Miscellaneous Maps; thence South 890 59' 32" .West 382.07 feet to the true point of beginning; thence North 00 la' 30" East 95.00 feet; thence South 890 59' 37" West 190.00 feet to the East line of the West 92.00 feet of said section; thence South 00 10' 30" West 115.00 feet to the northwest corner of said Tract No. 2228; thence along the boundary of said Tract, North 890 59' 32" East 175.00 feet, North 00 10' 30" East 20.00 feet and North 890 59' 32" East 15.00 feet to the true point of beginning. That the owner(s) of subject property shall pay to the City of Anaheim the sum of l5~ per front foot along Beach Boulevard for tree planting purposes. 2. That street lighting facilities along Beach Boulevard shall be installed as required by the Director of Public Utilities, and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 3. That driveways shall be installed along Beach Boulevard as. required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. -2- 5. That a 6-foot masonry wall shall be constructed along the north, east, and south property 1ine(s). 6. That all air-conditioning facilities. shall be properly shielded from view, and the sound buffered from adjacent residential property. 7. That 5ny parking area lighting proposed shall be down-lighting of a maximum height of 6 feet, which lighting shall be directed away from the property lines to protect the residential integ- rity of the area. 8. That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes, as adopted by the City of Anaheim. 9. That subject property shall be served by underground utilities. 10. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 11. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 12. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. land 2, above mentioned, shall be completed. The provisions or rights gran.ted by this resolution shall become null and void by action of tfie City Council unless said conditions are c~nplied with within 180 days from the date hereof, or such further time as the City Council may grant. 13. That Conditions Nos. 3, 4, 5, 6, 7, 8, 9, 10, and 11, above mentioned, shall be complied with prior to final building and zoning inspections.
