Orange, state of California, as per map recorded in book 115, pages 15 and 16 of P1iscellaneous Maps in the office of the county recorder of said coimty. {VijEREAS, the City Planning Commission did holci a public liearing at the City Hail in the City of Anaheim on September 3, 1975, at 1:3(1 p,m., notice of said gublic heasing having been duiy given as renuired by law and in accordance with the provisions of tlie Anaheim P9unicipal Cnde, .Chapter 13,(13, to hear and consider evidence for anci agai.nst said proposed variance and to investi~;ate and make f.indings and recommendations :.t: connection thereiaith; and WHGREAS, snid Commission, af.ter due inspection, investi~ation and study made by itself and in its behalf, and after dtie consideration of all evidence and reports offered at said hearing, does find and determine the following facY.s: 1. That the petitioner reque~ts the following waivers from the Anaheim Dfunicipal Code, to permit seven (7) existing, free-standing signs: (a) SECTIOPI 1S.OS.OJ3.021 - idaximum munber of signs. (tlne free- standing sign permitteci; 7 existin~) (b) SECTION 1R.05.(193.023 - Permitted sign location. (Atidcile 20~ required; existing signs located adjacent to ~rorerty line) (c) SECTION 18.05.093.Q231- Dfinimum distance between si,ns. (3Q0 eet required; approximately 75 feet an~l 3 feet existing) 2. That Yhe above-mentioned waivers ar~ hereby deniect on the basis that tlie petitioner did not demonstrate that a hardship would be created if said waivers were not granted; that any hardship regarding signing on subject property may be solveci by expanding the existing free-standing sign; that, fiirthermore, approval of said waivers ~vould set an undesi.rable precedent for future similar reRuests, and that tlie Planninp Commission has denied similar requests ir. tlie past. 3. Tha*. there are no exceptional or extraordinary circumstances or conditions applicaule to the property involved or to the intended use of the property tnat do not apply generally to the prop~rty or class o~ use in the same vicinity and zone. 4. That the requr;sted variance is not necessary for ths preservation and enjoyment of a si;3stantial property right possessed by other property in the same ~~icinity and zone, and denied to the property in question. 5. That the requested variance will be materially detrimental to the puhlic welfare or injurious to the property or zmprovements in such vicinity and zone in which tihe property is located. 6. That no one indicated their presence at said piiblic hearing,in opposition; and no correspodence was received in opposition to subject petition. ENVIRONhfENTAL IhiPACT REPORT FINDITG: That the Director of the Planning Aepartment has determined that the proposed activity falls within the de£inition of Section 3.01, Class 11, of the City of Anaheim Guidelines to the ReRuirernents for an Enviranmental Impact Report, and is, thereforP, categorically exempt from the requirement to file an EIR.
